【新唐人2015年02月14日讯】《新唐人》最近再次收到了一批亲笔签名,并按下红色手印的名单。这是继上个月之后,第二批签名声援营救法轮功学员庞友的北京市民,共有215人。加上第一批的97人,签名总数目前已达到312人。
北京首次出现民众签名按手印营救法轮功学员的事件,人数正不断的增加。北京市民闫女士姐妹俩都签了名,尽管北京由于其首都的地位,在中共长达16年对法轮功学员的迫害中,受到更加严格的管控,但姐妹俩都表示不害怕。
北京市民闫女士(妹):“不害怕。我没炼,但是我也知道法轮大法好,炼法轮功的人都是好人,不做损人利己的事,都是为别人着想。”
北京市民闫女士(姐):“不害怕,害怕什么?现在不像先前那样。”
庞友原是北京朝阳区洼里乡奥运村规划办主任,后来又担任洼里乡乡办旭日房地产开发公司经理。“法轮大法明慧网”报导,98年,庞友目睹白血病晚期的老母亲修炼法轮功一周后奇迹般康复,自己也开始修炼法轮功。之后他杜绝了一切馈赠贿赂,在一方乡亲和业界朋友中名望很高。
99年中共开始镇压法轮功以后,庞友先后被非法绑架7次,关押长达12年。去年12月5号,庞友刚被释放不久,陪亲戚到延安,去拜访生意上的朋友。由于当地发现法轮功真相材料,庞友遭到宜川县公安局城关派出所怀疑,再次被非法绑架关押。之后中共公检法部门在没有证据的情况下,对他用《刑法》第300条定罪,非法批捕。
就庞友的所谓“罪名”,《新唐人》采访了一位要求匿名的北京人权律师。
北京人权律师:“实际上司法实践当中,有一些比较有良知的法官,或者是司法实践中大家也都非常清楚,就是公民纯粹修炼法轮功功法,是不能够作为犯罪处理的,而且这也没有法律依据。”
这位北京人权律师指出,中国也没有法律规定,持有信仰物品,例如法轮功的书籍和宣传资料属于违法。而《刑法》300条所谓“利用邪教组织破坏法律实施”的罪名,本身才是违反《宪法》。
北京人权律师:“300条违反《宪法》。因为《宪法》保护人权,还有36条:公民有信仰自由。那么《刑法》300条本身又没有可操作性,在操作过程当中,它就很难执行下去,后来又关于使用《刑法》300条,有两高的司法解释一,后来又进一步补充了二。但是这个一、二,又进一步践踏了《宪法》,而且还违反了《立法法》的相关规定。”
和不再害怕,公开签名声援营救庞友的北京市民一样,这位北京人权律师也提到,多年来,在帮助法轮功学员维护合法权利的过程中,他丢掉了恐惧。
北京人权律师:“勇气来源于几个方面,一是对中共的绝望。另外也是来源于信仰群体的鼓励,不断的感动。律师之间在交流的时候都有一个共同的感受,就是这个群体特别的让人感动,让人敬佩。那比起这个群体的每一个人,我觉得正义律师,或人权律师做的还不够,还远远的没有达到自己所能够努力做到的那种境界。”
目前,已有北京维权律师介入庞友案,然而在中国各地还有许多法轮功学员,正受到和庞友相似的迫害。
一位大陆律师从16年来,海内外针对中共借用法律陷害法轮功的法律论述资料中,整理出一份法律材料,在网络公布。他表示,既提供给法轮功学员,也提供给参与打压法轮功的公检法政府公职人员做参考,“不仅要明确信仰法轮功的合法,更要明确当今法律体系在犯罪”。

Beijing Citizens Bravely Supported Falun Gong Practitioners
New Tang Dynasty Television (NTDTV) recently received
another list of autographs and red thumbprints.
Since last month, this is the second batch of Beijing citizens
who signed and petitioned to rescue Falun Gong practitioner, Pang You, and there are 215 people in total.
Coupled with the first batch of 97 people, the total number
of signatures has reached 312.
This is the first time in Beijing that its citizens are using
signatures and thumbprints to rescue Falun Gong practitioners and the number is constantly increasing.
As Beijing citizens, the Yan sisters have both
signed their name.
Beijing has been subjected to more stringent controls during
the Chinese Communist Party’s (CCP) 16 years of persecution
against Falun Gong practitioners because of its status as the
capital, however, the two sisters said they have no fear.
Beijing citizen, Ms. Yan (Younger sister): I am not afraid.
I do not practice Falun Gong, but I know it is good,
Falun Gong practitioners are good people, they do not do selfish things, and are always considerate of others.
Beijing citizen, Ms. Yan (Younger sister): I am not afraid, why
do I have to be? Times have changed.
Pang You was originally the plan director of the Olympic
Village in Wali Town, Chaoyang District, Beijing, and he also
served as a manager of a real estate development
company in that area.
Minghui.org reported that, in 1998, Pang You began to practice
Falun Gong after he witnessed his mother’s miraculous recovery from terminal leukemia just one week after her practicing.
Since then, he rejected all kinds of bribery, and became
prestigious among the people and friends in the industry.
After the CCP started persecuting Falun Gong in 1999, Pang You
has been illegally abducted seven times, and imprisoned for 12 years.
On Dec. 5 last year, Pang You accompanied his relatives to
visit business friends in Yan’an shortly after he was released.
Pang You was suspected by the Chengguan Public Security
Bureau, Yichuan County, because there were Falun Gong
materials found locally, and he was then illegally
abducted and detained again.
Afterwards, in the absence of evidence, the CCPs public
security department used Section 300 of “Criminal Law" to
convict and illegally arrest him.
NTDTV has interviewed a Beijing human rights lawyer who
requested anonymity on Pang You’s so-called “offenses".
Beijing human rights lawyer: In fact, during the judicial
practice, there are some conscientious judges, and we are
all clear that citizens cannot be convicted just because they
practice Falun Gong, there is no legal basis.
This Beijing human rights lawyer pointed out that, there is no
legislation in China that state, holding items related to
one’s belief, such as the Falun Gong books
and materials, is illegal.
The so-called charge of “using a cult organization to
undermine law enforcement" mentioned in the Section 300 of
“Criminal Law" is a violation of the “Constitution" itself.
Beijing human rights lawyer: Section 300 violates the
constitution, because the constitution protects human rights,
and its Section 36 states that citizens have the
freedom of belief.
Section 300 of Criminal Law has no operability, it is
very difficult to implement during practice.
Later, two judicial interpretations on how to implement
Section 300 were added.
However, these two interpretations further violate
the constitution, as well as the relevant provisions
of Legislation Law.
Just like those fearless Beijing citizens who signed and
petitioned to rescue Pang You, this human rights lawyer
also mentioned that, his fear was gone during years of
safeguarding Falun Gong practitioners’ legitimate rights.
Beijing human rights lawyer: My courage comes from several
aspects, one of which is the CCPs hopelessness.
In addition, the encouragement from this belief group has
constantly touched me.
Lawyers have a common feeling when they are communicating,
that is, this group of people is touching and admirable.
Compared to them, I feel we, the human rights lawyers, have
not done enough, our achievement is far below what we
can reach with our full efforts.
At present, there are Beijing human rights lawyers involved
in Pang You’s case.
However, many Falun Gong practitioners are suffering a
similar persecution throughout China.
A mainland lawyer has sorted out a set of legal materials
based on legal resources about how the CCP framed Falun Gong
over the past 16 years, and published them on the Internet.
He said that it is provided to both the Falun Gong
practitioners as well as those public officials in the public
security department who are involved in the
persecution of Falun Gong.
Not only to clear the legitimacy of Falun Gong, but also
to clearly show today’s legal system is committing crimes.
