【新唐人2012年8月28日讯】日本的亲中大报《朝日新闻》最近披露,在北戴河会议上,胡锦涛派系占据优势,中共高层已作出剥夺前重庆市委书记薄熙来党籍的决定,并打算取消他的人大代表职务等。报导并分析,薄熙来今后很可能将被追究刑事责任。
《朝日新闻》是在周日(8月26号)的头版披露薄熙来将被开除党籍的消息。报导指称,这一决定是8月上旬在北戴河会议上作出的,而消息来源是数名接触过与会者的中共党内有关人士。这一决定,预计将在18大前举行的中共中央委员会全体会议上正式公布。
按中国共产党章程规定,失去党籍分为5级,而开除党籍是最为严厉的处分。《朝日新闻》的报导分析,这意味着薄熙来完全下台,同时今后薄熙来可能将被追究受贿嫌疑的刑事责任。
不过,美国“南加州大学”公共政策博士叶科认为,开除党籍只是党内处分,不能取代法律处分和刑事处罚。
美“南加州大学”公共政策博士叶科:“这其实就宣告了薄熙来政治生命的彻底终结。另一方面, 如果以党内处罚能够减轻薄熙来这个真正所应受到的法律处罚,这样就是党权凌驾于法律之上。实际已经是违反法律的一个做法了。当然它这个法律处罚还没有出来,所以我们还在观察。”
报导说,剥夺薄熙来党籍的决定,显示胡锦涛派系在权力斗争中占领优势,而处于下风的江泽民派系凝聚力低下。
时事评论员林子旭认为,将薄熙来开除党籍的处理结果如果属实的话,应该是江派和胡派彼此权斗又彼此妥协的结果。
时事评论员林子旭:“对于薄熙来这样罪大恶极的人,仅仅给予开除党籍的处分,从哪个角度也是说不过去。这个处理决定相比于外界的预料是轻了很多。我猜测为了保证十八大前后时局的稳定,中共很有可能在十八大前只对薄熙来予以开除党籍的处分,至于追究刑事责任很有可能就留在以后了,这样既可以对各界有一个交代,同时也不至于在党内引起太大的振动。”
叶科分析,薄熙来罪行累累,对于他的刑事处罚可能会比较重。因为如果轻判的话,不仅难以服众,也说明现在掌权一方的软弱。
叶科:“薄熙来犯的罪可以说是非常的多,他在大连的时候对法轮功学员的迫害非常多,法轮功学员被迫害致死以及后来被活摘器官,再有尸体被贩卖这些罪行,包括他在重庆唱红打黑,都迫害死了很多民营企业家,包括非法剥夺他们的财产。包括后来王立军案这一系列的事情。薄熙来的罪行是非常严重的。”
林子旭举例,中共历史上曾有过邓小平翻身的先例,因此,只要薄熙来活着,胡锦涛就会给自己留下隐患。而能够让中共党官们,包括薄熙来在内,不断行恶的保护伞,恰恰是中共这个体制。
林子旭:“中共这个体制恰恰就是他们行恶的保护伞,要想让这些人真正接受审判,唯一的办法就是先清除中共这个体制。”
此外,由于薄熙来仍是全国人大代表,如果遭到刑事起诉,按程序要先免去人大职务。
除了《朝日新闻》有关薄熙来人大代表资格这一“护身符”可能被摘除的消息,中共官方的一则报导也引起外界关注。
据《新华网》报导,11届全国人大常委会第28次会议,27号起在北京举行。会议的其中一项内容是审议“关于个别代表的代表资格的报告”。这里的“个别代表”被认为是指向薄熙来,而这个议程则被视为:拔除薄熙来人大代表资格的处理方案,已经提上议程。

Bo Xilai Stripped of Party Membership, investigated for his criminal liability?
Japan’s largest Pro-China newspaper, Asahi Shimbun,
recently disclosed that Hu Jintao’s faction had
gained advantage in the Beidaihe meeting.
Senior members of the Chinese Communist Party(CCP) made
a decision to strip the former Chongqing Party Secretary,
Bo Xilai, of his party membership; also stopping him from
representing the People’s Congress.
According to reports and analyses, Bo Xilai is likely to be
investigated for criminal responsibility in the future.
August 26—Japan’s Asahi Shimbun run a front-page report,
that Bo Xilai would be expelled from the CCP; the decision
had been made in the Beidaihe meeting in early August,
according to several sources who are in contact with the CCP.
It’s expected to be formally announced before the CCP’s 18th
Congress, at the CCP Central Committee’s plenary session.
Provisions of the of the CCP Constitution states that,
there are 5 categories in losing party membership,
and being expelled from the party is the most
severe punishment.
In the analysis, Bo is said to completely step down;
he will likely be held for bribery charges later.
Yet, Dr. Ye Ke, from the University of Southern California’s
School of Public Policy believes that,
being expelled from the party is only a punishment
within the regime;
it cannot be a substitute for legal sanctions
and criminal penalties.
[Dr. Ye Ke, School of Public Policy, USC]:
“It’s a declaration of an end to Bo’s political life;
on the other hand, if punishment within the party can reduce
Bo’s legal punishment, it also means that the party is above the law.
In actuality, it is a violation of the law, the legal punishment
has not been given yet, so we are still observing."
The report says, the elimination of Bo’s party membership
shows that Hu Jintao’s faction has gained an upper hand in the power struggle, with Jiang’s faction at a disadvantage.
Political commentator, Lin Zixu, thinks that,
if Bo Xilai is indeed being expelled,
it may result from a compromise
between Hu Jiantao and Jiang Zemin’s factions.
[Lin Zixu]: “For someone as wicked as Bo Xilai to
only receive expulsion from the party, no matter how you look at it, it is not justified;
the sentence is much lighter than the outside world expected.
I guess, the CCP is likely to only expel Bo from the Party,
in order to ensure the stability of the current situation around the time of the 18th Congress;
criminal responsibility to be taken by Bo is likely
to be investigated in the future.
By doing so, the CCP brings a disclosure to the case, while
at the same time, not causing shock waves within the Party.”
Ye Ke analyses that Bo Xilai has committed too many crimes,
so his criminal penalties may be heavier.
A lenient sentence cannot convince people and also shows
the weakness of the party.
[Dr. Ye Ke]: “Bo’s crimes are many, including involvement
in persecuting Falun Gong practitioners in Dalian—
many practitioners lost their lives—as well as
organ harvesting and body trafficking.
During Bo’s anti-crime campaign in Chongqing,
many private entrepreneurs were persecuted to death,
and their properties were also unlawfully embezzled.
Later, the Wang Lijun incident also exposed many of
Bo’s very serious criminal offenses."
Lin Zixu points out that, in the history of the CCP,
Deng Xiaoping had turned around and set a precedent.
Thus, as long as Bo is alive,
Hu Jintao will have something to worry about,
since it is precisely the CCP’s system
which allows its officials,
such as Bo Xilai, to continue to do evil,
while at the same time, protecting them.
[Lin Zixu]: “The CCP system is precisely the umbrella
that is protecting those people who do evil;
the only way to truly bring people to trial,
is to first clear the governing system in China."
Since Bo Xilai is still in the National People’s Congress,
he must be first removed from the congress if criminal prosecution is to proceed.
In addition to Japanese newspaper, Asahi Shimbun’s report,
the CCP’s official report also attracted international attention,
saying that, Bo Xilai’s status as deputy Party secretary
in the People’s Congress may also be removed.
The CCP mouthpiece news agency, Xinhua, reported that
the Standing Committee of the National People’s Congress
had held the 11th session of their 28th meeting in Beijing on August 27.
Xinhua told on the qualifications of specific deputies, using
the term, “individual representatives”, to point to Bo Xilai.
The news piece took the agenda: “Unraveling Bo Xilai’s
qualifications as deputy CCP secretary”.
