【新唐人2013年04月16日訊】日前，「上訪媽媽」唐慧，訴請「永州市勞教委賠償案」被一審駁回﹔而，「浙江杭州強姦冤案」的當事人張高平，也是坐了10年的冤獄，他的賠償目前似乎也沒有了下文。中共喉舌《人民日報》最近針對唐慧、及張高平案提出批評。這是中共中央與地方當局的意見不一嗎? 一起去看詳細報導。
針對唐慧及張高平案，《人民日報》批評指出，每一個判例，都是公眾法治信仰的基石﹔而每一次失誤，都可能導致信仰的崩塌。具體到唐慧案，除了關注「勞教決定是否合法，撤銷決定是否意味著必須賠償」的爭議，公眾同樣希望看到湖南省政法委兌現去年8月作出的承諾，徹查唐慧女兒被逼賣淫案，及時公布調查結果，在這起始終伴隨爭執和猜疑的案件上給社會一個清楚明白的答案。
《人民日報》還說，「沒有信心，就沒有信仰。讓公民信仰法律，法律須給公民以信心。這就需要執法者公正對待公民的合法訴求。」
4月12號，唐慧訴求永州市勞教委賠償的案子，被一審駁回，唐慧走出法庭之後，掩面痛哭，她說還要上訴。
而張高平在宣判無罪的法庭上，對法官說：「你們今天是法官和檢察官，但你們的子孫不一定是。如果沒有法律和制度的保障的話，你們的子孫也可以被冤枉，也可能徘徊在死刑的邊緣。」
《人民日報》這篇標題為：《盡心呵護公眾對法治的信仰》文章，希望地方當局要通過「對一起起司法個案」的公正處置，把法治精神、法治意識、法治觀念深深熔鑄於公眾的心中。文章最後還特別提到所謂，「黨的十八大重申全面推進依法治國的目標」。
原《河北人民廣播電臺》編輯朱欣欣﹕「只能說明中共對媒體的控制，或對各地的控制，不是完全能夠控制得住的、能夠統一起來的。地方有地方的利益，中央有中央的考慮，他們雙方還是有矛盾的。還有一種情況呢，就是中央他們內部也是有不同的派別在進行博弈，一派可能控制不同的系統，他們各自也產生矛盾。」
據報導，張高平被屈打成招，警方還準備了認罪書，逼迫張高平抄寫，而認罪過程，完全由杭州市公安局刑偵支隊預審大隊大隊長聶海芬一手主導，她還自誇透過「突審」方式，取得「無懈可擊」的鐵證，才將張高平叔侄二人定罪入獄。
聶海芬在4月2號的微博出現，聲稱「我不是惡警察，不能坐牢，坐牢的應當是公安局長、檢察院長、人民法院院長！」，她還表示，「你們知道政府有個政法委、法院有個審委會…每個案件，你們知道是誰定的調子嗎？」、「你們敢向政法委叫板嗎？」
朱欣欣﹕「過去的既得利益者他不願意出讓自己的權利，他就要拚命的來保護自己的權利，同時，他要捂蓋子，要掩蓋自己過去的一些過錯，對立的一方就要通過揭露他的一些醜聞、一些問題、一些罪行來從社會輿論方面，從各個方面來打擊對方。」
北京憲政學者陳永苗表示，從90年代中央和地方財政實施分稅制度之後，地方的財政通過土地財政，不再依賴中央政府，因此，地方開始不聽中央的話，政令不出中南海。
陳永苗﹕「所以胡錦濤、溫家寶他們就想出一個辦法，利用網絡媒體或者中央媒體來搞地方政府，然後造成事情大了，他就從政治上把他們官位撤掉。」
陳永苗認為，雖然中共內部矛盾激烈，但對外面的人來說，都是一體的，沒有矛盾。因此，政法委撤銷不撤銷﹖地位上升不上升﹖對外部的人來說卻沒甚麼影響。

Hidden Agenda Behind People’s Daily Comment Up On Law Enforcement
Recently, the Chinese Communist Party (CCP) mouthpiece,
People’s Daily, commented on court rulings of two cases.
They are: Tang Hui’s case, “Requesting compensation from a
Labor Camp in Yongzhou City”, being rejected at first instance;
Zhan Gaoping’s wrongfully detained for 10 years,
the compensation was never realized.
Did this commentary signal the difference between
local & Central authority ?
Referring to the cases of Tang Hui and Zhang Gaoping,
People’s Daily commented.
It said that each jurisprudence should build public faith in law,
with any mistake possibly leading to a collapse in that faith.
It questioned if the labor camp decision was legal and if
compensation should occur when the decision was withdrawn about Tang Hui’s case.
It also urged Hunan Provincial Politics and Law Committee to
honor the commitments made last August.
They are to investigate into the forced prostitution case
involving Tang Hui’s daughter.
And announcing the findings in a timely manner, resolving
the social disputes and mistrust associated with the case.
People’s Daily stated, “No confidence, no faith.
The law must provide the confidence to the citizens so they
have faith in that law.
It demands law enforcement according to the citizens
legitimate quest."
April 12, Tang Hui’s case, demanding compensation from
Yongzhou City Detention Committee, was rejected in the first instance.
Tang Hui broke down outside the court room saying,
“I will make an appeal!”
Zhang Gaoping said to the judge after being recognized
as innocent, “You are the judges and prosecutors, but your children might not be.
Without a legal and institutional protection, your children
may also be wronged, hovering at the edge of the death penalty."
People’s Daily article entitled, “Dedicated care to public
belief in law", asking the local authorities to treat each case
with fairness and to bring the spirit of awareness of law
to the people.
At the end It promoted, “March towards the goal of governing
by laws according to the Party’s 18th National Congress.”
Former Hebei People’s Radio Editor Zhu Xinxin: “It shows
that the CCP’s media control has not reached a consensus.
There are conflicts between the local and the central bodies.
Also, even within the central, conflicts exist in
different factions and systems."
It was reported, Zhang Gaoping experienced
forced confessions.
The police had a prepared confession and forced Zhang to
write accordingly.
The entire process was single-handedly led by Nie Haifen,
the Hangzhou Public Security Bureau Criminal Investigation Detachment pre-battalion.
She boasted how she had employed a “surprising” method to
obtain the iron evidence which convicted Zhang and his imprisonment.
Nie Haifen wrote a microblog on April 2 claiming,
“I am not a bad cop and can not be sent to jail.
The people who are supposed to go to jail are the directors
of the Public Security Bureau, the Procuratorate, and the People’s Court."
She continued, “You know the Politics and Law Committee,
the judicial committee in the Court …
Do you know who sets the tone for each case?
Do you dare to challenge the Politics and Law Committee?"
Zhu Xinxin: “People with vested interests will not let
go of the benefit.
They will desperately defend themselves.
While covering up their own mistakes, they expose their own
crimes by setting up public opinions to attack their opponents."
Beijing constitutional scholar Chen Yongmiao said, since
separation of the tax system between central and local authorities in the 1990s,
local governments have relied on land finance, rather than
the central government.
The local authority no longer complies entirely
with Zhongnanhai’s ruling.
Constitutional scholar Chen Yongmiao: “Hu Jintao and
Wen Jiabao have therefore utilized the Internet
and the media to control local government by revoking
their official positions, once the opinions are made."
Chen Yongmiao indicated that despite the intense conflicts
within the Communist Party, they are still one tyranny.
Thus, whether or not the Politics and Law Committee will
be revoked makes no difference to outsiders.
