據大陸媒體報導,鐵道部巨額投資的「12306購票網站」,經常出現登錄難、購票難的情況,每逢長假,網站就經常癱瘓。有些訂票者看到網站上有餘票,參與網站排隊後卻發現,排到自己時票已售完。還有個別乘客反映:票沒訂上,錢卻被扣走。
一系列情況引起外界質疑。
「真功夫」餐飲(北京火車站分店)劉先生:「110網上訂票太難啦!根本系統癱瘓,根本訂不了。我要訂票都訂不了。223網站,經常有舉報現象啊,根本就上不了網。註冊的帳號也上不了網。」
上個月的9月24號,北京維權律師董正偉給鐵道部郵寄一份《政府信息公開申請書》,請求公開「12306網站」建設設計、服務、招投標過程的全部信息,以及網站總造價等,希望監督其中是否存在腐敗。
三天後(9月27號),鐵道部向媒體解釋了「新一代客票系統」招投標情況,但沒有說明「12306網站」的招投標內容。
北京維權律師董正偉:「216有媒體披露這個網站建設投了好多個億,大家認為花了好多個億建起來還不能用。那麼我有個疑問,這個網站到底花了多少錢。按照規定,壟斷性國有企業的投資行為,都應當經過招投標公開操作,而且在陽光下公開作業。」
董正偉表示,粗略估算,網站纍計投資至少在10億-20億元。
而在這個月(10月)的20號,董正偉向大陸《新京報》提供了「鐵道部政務公開領導小組辦公室」給他回覆的原文。董正偉向《新唐人》表示,鐵道部不僅沒有答復他任何一項問題,而且還讓他自己上網查詢相關信息。
董正偉:「答復的情況非常不理想。幾乎對12306網站招投標的信息沒有任何公開的意思,而且通過轉移視線的方式來迴避話題。12306網站從2010年上線以來,至少經過了5次的招投標,但是鐵道部現在拿著對內的一次『新一代客票系統』——12306網站升級活動的招投標,來模糊所有的問題。所以大家產生了更多的懷疑。」
值得一提的是,鐵道部在回函中稱呼董正偉為「公民」。
董正偉:「國內一般說同志,要嘛,就後面直接寫名字,後面甚麼都不寫,或者寫先生,女士。某種意義上他就是強調我們之間(社會地位)懸殊,不對等。他就是要告訴你,你是公民,我是官,你是民,是這麼個含義。」
董正偉表示,他已經先後向國家發改委、中紀委、監察部和工商總局舉報,「12306網站招投標涉嫌違規」。10月9號他收到國家發改委電話,聲稱這個項目發改委沒有審批,應當向中紀委、監察部舉報。
那麼,接下來他會如何做呢?董正偉說,他準備再給鐵道部一次機會,再向鐵道部提出行政復議,繼續要求信息公開。但如果還是不公開,就將進入行政訴訟的程序。
而記者向鐵道部辦公廳諮詢時,接聽電話的工作人員說「此事不歸他們管」,也沒聽過「鐵道部政務公開領導小組辦公室」。
大陸民主人士恩廣:「中國大陸各個行業哪有不貪腐,他們把很大部分資金貪污走了,剩下一部分用於建設,都是草草了之。」
除了董正偉律師,還有一位「西北師範大學」的大二女生黃煥婷,也向鐵道部寄出了申請函,申請公開鐵道部耗資1.99億元的「新一代客票系統一期工程項目」的具體項目內容。黃煥婷說,每個普通公民都能依法行使自己的知情權。

Ministry of Railways Refuses to Publicize Website 12306 Tender Information
Dong Zhengwei, a well-known Beijing human rights lawyer,
sent a letter to the Ministry of Railways asking the ministry
to publicize all information regarding bidding procedures
of Website 12306.
However, the Ministry of Railways quick replied with
irrelevant answers. This has triggered further questioning.
According to mainland media reports, the website 12306,
a huge investment of the Ministry of Railways,
often experiences login and ticket-purchasing difficulties.
Every holiday, the site often went down.
For some people, the site said tickets were available
on the website, however, tickets were all sold out when they attempted to purchase.
Other passengers commented that their cards were charged,
but they received no tickets.
This series of instances led to public skepticism.
“Real Effort Restaurant” Beijing Railway Station Branch,
Mr. Liu: “On website 110, online booking is too difficult!
The fundamental system is paralyzed, and I cannot order
tickets there.
On websites 223, I just cannot get online, even with
a registered account."
On Sept. 24, Beijing human rights lawyer Dong Zhengwei
mailed a copy of Disclosure of Government Information
Application to the Ministry of Railways and requested
the disclosure of website design, services, and the bidding process, including the costs.
He hoped to see monitoring of this website
and prevent corruption.
On Sept. 27, the Ministry of Railways explained the
bidding situation of the new generation of ticketing systems to the media,
but did not reveal anything regarding website 12306.
Beijing human rights lawyer Dong Zhengwei: “Some media
disclosed that billions of RMB were spent in the construction of this site, and yet it is not working.
Now I want to know just how much has been spent
in its construction.
In accordance with the provisions, all monopoly state-owned
corporate investment should be subject to the open bidding operation, operating openly under the sun."
Dong Zhengwei said that a rough estimate of the accumulated
investment on the website has been at least 1-2 billion yuan.
On October 20, Dong Zhengwei provided the response from
the Ministry of Railways Leading Group Office to Beijing News.
Dong Zhengwei told NTDTV that the Ministry of Railways
did not answer any of his questions and even asked him to find relevant information online himself.
Dong Zhengwei: “The reply is very unsatisfactory.
It offered no bidding information of website 12306 and even
tried to divert my attention to evade the topic.
Since the beginning of website 12306 in 2010,
there has been at least 5 biddings.
However, the Ministry of Railways is now holding internal
bidding for “the new generation of ticket system" and
using site 12306 to upgrade activities of the bidding
to blur all the issues. Now, everyone becomes more suspicious."
It is worth mentioning that the Ministry of Railways addressed
Dong Zhengwei as a citizen in the letter.
Dong Zhengwei: “People normally use ‘comrades’ in Mainland
or just write the name Mr. or Ms.
Now, he emphasized our (social status) disparity to tell you
that you’re a citizen, and I am an officer; you’re an ordinary citizen, but I hold a position."
Dong Zhengwei said that he had reported to the National
Development and Reform Commission (NDRC),
the Central Commission for Discipline Inspection(CCDI),
and the Ministry of Supervision and the Administration for Industry and Commerce,
regarding Website 12306 bidding alleged breach.
On October 9, he received a call from NDRC who claimed
that it has no jurisdiction and the case should be reported to CCDI and the Ministry of Supervision.
So, what should he do next? Dong Zhengwei said that he was
prepared to give the Ministry of Railways one more chance.
He would continue to demand information publicized.
If he fails, he will follow legal proceedings.
When the reporter called the Ministry of Railways, the staff
answering the phone said that the matter did not belong to them and he never heard of “the Leading Group Office.”
A democratic person En Guang: “Corruption is in all walks
of life in China.
They took the majority of the money and left a small sum
to build the website. It was built superficially.”
Besides Dong Zhengwei, a female college student Huang
Huanting also asked the Ministry of Railways to reveal
the specific projects of “a new generation of ticket system”,
which costs 199 million RMB.
Huang Huanting said, “Every ordinary citizen can exercise
his or her right to know.”
