【新唐人2015年01月09日讯】曾经引发国际社会关注的“建三江事件”,近来再起风波。1月8号上午,黑龙江建三江当局对4位法轮功学员,在没有律师出庭的情况下进行非法秘密庭审,当天中午庭审结束,将择期宣判。庭审时既没通知家属,也没通知律师。4名被告人在庭上讲述了遭到酷刑虐待的情况,但均没有被法院采纳。当天,8位代理律师到哈尔滨相关部门提出控告,并发出公开抗议书,要求追究相关人员的全部责任。
“建三江事件”始于去年3月,唐吉田、江天勇、王成、张俊杰4位维权律师,到黑龙江建三江为法轮功学员提供法律帮助时,与法轮功学员石孟文等人一起被绑架并遭到酷刑虐待,其中,石孟文、王燕欣、孟繁荔、李桂芳等4人一直没有获释。
1月8号上午9点,建三江农垦法院对石孟文等4名法轮功学员,进行秘密非法庭审,当事人家属在开庭前夕,遭到当局严密监控,他们的代理律师也被拒绝进入法庭辩护,4名当事人被审判长要求自行辩护。
王宇律师:“现在等于它违法的、秘密的给当事人开庭了,它不但没通知律师而且也没通知家属去旁听,我们今天到哈尔滨这边,包括到省人大、省高院、省高检,我们在控告。”
王宇和张维玉等辩护律师为了帮助法轮功学员,从去年12月17号至今,已经三次到建三江。1月7号,几位律师到建三江法院想问一下有关情况,遭到法院的刁难。
张维玉律师:“我们在建三江要去见审判长,他要求查验我们律师证以后,要查验身份证,查验了身份证之后,还要对我们人身安检,这个我们实在无法接受,我们就直接走了。”
张维玉律师说,当天他们又去佳木斯看守所会见当事人,但看守所说建三江法院发函,不让律师会见。
蔺其磊律师:“他们是肆无忌惮的违法,上一个月29号、30号,我们3个被告人律师都过去,被告人重新坚决还是继续委托我们律师,去做他们的辩护律师,然后,我们当天就赶到建三江法院,我们七、八个律师进法院见到庭长王敬军,把新的委拖手续提交一下。”
蔺其磊律师说,在这期间,突然进来四个法警强行把他们赶出去了,要他们进行登记和安检。
去年12月19号庭审时,建三江农垦法院庭长王敬军就曾经以手机震动为由,取消了代理律师王全章的辩护资格,还以代理律师刘连贺没有经过律师所主任的同意私自接案,宣布取消刘连贺的辩护资格,而且当时法院没收他们的电脑、U盘等,至今仍未归还。
除了代理律师们遭到骚扰和刁难外,当事人家属也遭到当局的严密监控。
当事人石孟文的侄子小石说,庭审的前三天,石孟文父母家门外就出现了20多名监控人员。
石孟文的侄子小石:“石孟文的姐姐家也是,晚上楼下有两台车,石孟文的嫂子的妹妹也是,天天有3个人跟着他们。然后,家属要去买菜也不让,后来质问他们,他们给管事的打电话,他们说你要买菜呢,要监控的人跟他去,就是不让出去。”
总部位于美国的《明慧网》7号报导,去年底,当事人孟繁荔的姐姐到建三江法庭,去旁听对妹妹的庭审,被劫持到警车上,陪同她的两个朋友也被劫持关押,她们回家后,继续遭到当地政法委上门威胁恐吓,吓得她再也不敢管妹妹的事了。
王宇:“我们现在有一个公告,我们成立一个建三江案法律后援团,我们要对这个案件违法性要做一些后续工作,不仅是法庭上的辩护工作,包括它庭审的违法,包括各方面的违法行为。”
8号下午,8名代理律师公开发表了抗议书表示,将穷尽所有法律救济途径,对这起案件中的涉嫌违法人员追究全部责任。

Jiansanjiang Lawyers File Complaint Against Illicit Secret Trial
Chaos again arose with the Jiansanjiang case.
On Jan. 8, morning—Jiansanjiang authorities led an illegal,
secret trial against four Falun Gong practitioners.
The trial ended at noon and the verdict is yet to be given.
The court rejected the defendants’ claim of suffering
torture and abuse in the detention center.
Neither the defendants’ families nor their defense lawyers
were notified of the trial.
On the same day, eight defense lawyers filed complaints
to authorities in Harbin and issued an open letter of protest,
demanding the prosecution of all relevant officials.
The Jiansanjiang case first took place in March 2014, when
four human rights lawyers, Tang Jitian, Jiang Tianyong,
Wang Cheng and Zhang Junjie were kidnapped and tortured
in a detention center, during their legal service defending
seven illegally detained Falun Gong practitioners.
Practitioners, Shi Mengwen, Wang Yanxin, Meng Fanli
and Li Guifang are still detained.
The Jiansanjiang Court started the illegal, secret trial
against the four victims at 9:00am on Jan. 8.
The defendants’ families were closely monitored
by authorities the day before the trial.
The lawyers were refused entry into the court room
and the judge ordered the defendants to defend themselves.
Wang Yu, Lawyer: “The court has violated the law in holding
a secret trial; none of the lawyers or families were notified."
“We came to Harbin today to file complaints to the People’s
Congress, the High Court and the Supreme Procuratorate."
The defense lawyers have visited Jiansanjiang three times
since Dec. 17, 2014 to help the Falun Gong practitioners.
On Jan. 7, the day before the trial, the lawyers
had met resistance at Jiansanjiang Court.
Zhang Weiyu, Lawyer: “We went to see the presiding judge
at Jiansanjiang and were asked to see our law permits and ID,
then they wanted to do a body patdown—we really couldn’t
accept it, so we left."
He says they also went to Jiamusi Detention Center to meet
their clients, but were refused due to “court orders".
Lin Qilei, Lawyer: “They are blatantly violating the law.
On Dec. 29 and 30, the three of us met our clients, who
indicated their firm request to entrust us to defend them,
so we visited the court that day and met Judge Wang Jingjun
and submitted our new commission form."
Lin Qilei says, four bailiffs then suddenly showed up, pressed
for registration and security checks, and drove them away.
In the Dec. 19 trial, Judge Wang Jingjun disqualified attorney
Wang Jingjun from defending, due to his cellphone vibrating.
The judge also disqualified attorney Liu Lianho’s defense,
saying he had taken the case without consent of his law firm.
The court also confiscated their computers and U-disks
without ever returning them.
As well as harassing the attorneys, the authorities
also closely monitored the defendants’ families.
Defendant Shi Mengwen’s cousin, Xiaoshi, says
Shi’s parents were monitored by 20 agents.
Xiaoshi: “Shi’s sister was also monitored by two cars at night
and his sister-in-law was also followed by three people."
“Going out for grocery shopping was forbidden, and when
we questioned the agents, they said they would follow us
to go shopping, but mostly we were not allowed to go out."
According to reports by Minghui.org, defendant Meng Fanli’s
sister had gone to the court hearing, but was then abducted
into a police car and detained, along with two other people
who were accompanying her.
After returning home, the local Politics and Law Committee
continued to harass them.
Meng’s sister felt terrified and was unable to
continue paying attention to her sister’s case.
Wang Yu: “We have announced to set up a law assisting
group to follow the authorities’ illegal acts, including illegal
procedures in court and all other offenses."
The lawyers published their letter of protest on Jan. 8
and say they will exhaust all legal means to pursue charges
for the officials to take full responsibility for the illegal acts.
