【新唐人2014年12月29日讯】蒙古族学者和异议人士哈达,被中共监禁了19年,受尽了折磨,导致他出现了严重的身体和精神问题,本月才刚获得自由。哈达的妻子和儿子也都曾经被以不同罪名判刑。现在,哈达要对此提出控告,并且重点起诉中共对他4年“黑监狱”的非法关押。请看以下报导。
中共执政以来,大量汉族人口涌入内蒙古地区,造成蒙古族在内蒙古反而成为少数族群。目前蒙古族在内蒙古的总人口中,仅占不到五分之一。
1995年蒙古族异议人士哈达想保护濒临消亡的蒙古人文化,以及蒙古人的利益,创办了“南蒙古民主联盟”。同时,他还是《内蒙古之声》杂志的主编。不过在当年12月10号,哈达就被控以“分裂国家罪”和“间谍罪”被判处15年监禁。
哈达表示,为了逼迫他认罪、放弃思想,中共在监狱里用尽了各种方法,包括关“小号”、冬天在露天工作、每天24小时不给取暖等手段,还对他长期使用对身体有副作用的药物等。
当局的这些招数,直到哈达刑满前也没有使他屈服。
不过,在2010年底前,也就是在哈达出狱前,中共又把他的妻子新娜和儿子抓到看守所,说是在他们的书店仓库中发现毒品。因此,哈达在15年刑满后又被送进一家“黑监狱”。
蒙古族异议人士哈达:“因为非法拘禁是犯罪行为,我们不应该被他们这样陷害。你看看我被非法拘禁4年,而且老婆孩子也都被判刑。这都相当违法的,那宪法规定不明文规定,不许非法拘禁人吗?”
今年7月,哈达的妻子新娜向中共国家主席习近平、联合国人权委员会,以及美国国会外交人权委员会发出了控告信。在信中,她重点提出了当局在最近4年对哈达及家人的新犯罪行为。
12月25号,哈达的妻儿透露,哈达将控告中共当局非法拘禁他,并使他出现严重的精神问题。
旅美民主人士唐柏桥指出,哈达是因言获罪,实际上他并没有任何违法行为。他对当局提出控告完全是正当的,这在民主国家也是非常常见的做法。
旅美民主人士唐柏桥:“他这样做,至少可以彰显中共不守法,因为至少他可以从几个方面起诉他们:一个就是酷刑,酷刑虐待﹔另外一个就是非法拘禁。”
唐柏桥表示,哈达还可以根据国家赔偿法要求赔偿﹔也可以根据被监视、被非法拘禁等违法行为进行控告。
唐柏桥认为,哈达的控告不管结果怎样都是有意义的。就像很多大陆人权律师为法轮功学员做无罪辩护辩护那样,虽然对判决结果影响不大,但能让人们看清中共的虚伪和丑陋,看清中共的依法治国只是一句空话。
哈达对《新唐人》表示,因为他不放弃思想,当局目前还是把他视为敌人,对他依然实施监控。
哈达:“他们还是继续,而且我估计不是国保一个单位,我估计有好多机关在这院里住呢,都是为了监视我。”
哈达还披露,因为他最近接受了外媒采访,导致他在呼和浩特打工的儿子被解雇。现在他的家庭失去了收入来源,家里当前的生活费都是靠亲戚、朋友接济,未来控告的律师费也成了他的心病。
哈达的妻子新娜日前在接受《路透社》时采访表示,这次起诉政府的重点不仅仅是过去四年中对哈达的“非法拘禁”,还包括她本人被控非法经营罪,以及他们的儿子被“非法持有毒品”等陷害行为。
唐柏桥指出,中共这种对异议人士家属株连的做法,是非常严重的侵犯人权行为。
唐柏桥表示,当年89六四学生绝食的时候,中共内部还有人同情。可是,香港这次学生绝食,不但中共表现的像铁板一样,连香港政府也没有任何同情心。这说明中共比以前更没有人性了。

Hada to Sue Communist Regime over 4-Years in Black Jail
Mongolian scholar and opponent Hada, just recently released,
suffered serious physical and mental illness after 19 years
of imprisonment.
His wife and son have also been sentenced for various offenses.
Hada will sue the Communist regime over these injustices,
in particular, the four-year extra-judicial black jail.
Since the rule of the Chinese Communist Party (CCP) began,
a large influx of Han Chinese population to Inner Mongolia,
resulted in the Mongols becoming the minority there.
Currently, Mongols only account for less than
one fifth of the population of Inner Mongolia.
In 1995, facing the endangered Mongolian culture,
Hada founded the Southern Mongolian Democratic Alliance
to protect the interests of the Mongols.
He was also the chief editor of the magazine,
the Voice of Southern Mongolia.
But, on Dec. 10 that year, Hada was sentenced
to 15 years in prison for separatism and spying.
He revealed that the regime had exhausted every means
to force him to confess and give up his ideas.
He was locked up in a small cell, worked in the wintry
weather for 24 hours a day without any source of heating,
and administered drugs with side effects.
None of these tortures, however, made Hada yield.
Then, right before Hada was released at the end of 2010,
his wife Xinna and son were both detained.
The regime claimed that drugs were found
in their bookstore storage room.
Hada was thus sent to a black jail after his 15-year term
was over.
Hada: “The illegal detention is a crime.
We should not have been framed.
Look at me, I was illegally detained for another 4 years
and my wife and son were also sentenced.
All of these acts were illegal. The Constitution has put it clearly
that illegal detention is not allowed."
In July, Xinna sent a letter of complaint to the Chinese
President Xi Jinping, the United Nations Commission
on Human Rights and the US Congress Foreign Relations
Committee on Human Rights.
In the letter, she highlighted all the new crimes the regime
committed against Hada and his family in the last four years.
Hada’s family revealed on Dec. 25 that they will file a lawsuit
against the Communist regime over the illegal detention
and the serious mental illness Hada has suffered
from the imprisonment.
Activist Tang Baiqiao agrees with the lawsuit.
He believes that this practice common in a democratic country
ought to be carried out
because Hada was punished for his speech,
but in fact did not violate any law.
Tang Baiqiao: “The lawsuit will at least highlight the fact
that the CCP violated the law.
The lawsuit can focus on two aspects of the case:
one is the torture, and the other, illegal detention."
Tang Baiqiao mentions that Hada can also demand
compensation under the State Compensation Law.
He is also entitled to sue illegal acts of the regime
such as the monitoring and illegal detention.
Tang Baiqiao believes the acts of the lawsuit would be
meaningful despite the outcome.
It is like the defense of human rights lawyers on behalf of
Falun Gong practitioners, even though the effect
on the verdict is minimal.
It shows clearly the hypocritical and ugly “rule of law"
manipulated by the CCP.
Hada tells NTD that the regime considers him the enemy
and continues to monitor him
because he does not give up his idea of democracy.
Hada: “They are still doing it.
I believe it’s not just the state security; there are people
from different units living in the community, just to watch me."
Hada says that his recent interview with foreign media
had led to his son being fired from his work in Hohhot.
Now his family has lost their source of income, but relies on
support from friends and relatives.
It also jeopardizes his future lawsuit attorney’s fee.
Hada’s wife, Xinna, said the lawsuit would focus not only
on overturning Hada’s “illegal detention" for the past four years,
but also her conviction for illegally operating a business
and their son Uiles’ drug conviction, charges the family denies ,
according to Reuters.
Baiqiao Tang asserts that the CCP involving the family
in the punishment is a very serious human rights violation.
Tang Baiqiao indicates that back in 1989 when the students
were on hunger strike, there were a few sympathetic officials
in the CCP.
But, in the Hong Kong students hunger strike,
not only the regime behaved like an iron,
but also the Hong Kong government showed no compassion.
This clearly shows the CCP has become even more inhuman
than before.
