【新唐人2014年12月18日讯】曾引发国际社会关注的黑龙江“建三江事件”虽然已经过去8个多月了,但至今仍有4名法轮功学员被非法关押。12月17号,这起案件终于开审。不过,当地警方在开庭前就大肆抓捕想旁听的人士、阻止证人出庭,并设置重重关卡,多方阻挠8位辩护律师进入法庭为法轮功学员做无罪辩护。
在“建三江事件”中,与律师同时被非法绑架迫害的法轮功学员共有7人,至今,仍有4名法轮功学员被非法关押,包括石孟文、孟繁荔、王燕欣和李桂芳。由于恐惧案件的影响力,庭审日期一延再延。
17号早上,有不少大陆网友在微信、微博等社交媒体上,转发关于建三江事件的最新消息,指法庭所在的前进农场的进出通道,已被大批特警把持。当天共有8名辩护律师,包括王宇、蔺其磊、王全章、唐天昊、陈智勇、张维玉、袭祥栋,以及刘连贺。其中,王宇、蔺其磊等4位辩护律师和一位前去旁听的律师,乘车赶往法庭时,遭到拦截。
王宇律师透露,建三江当局设了三道关卡,他们在第一道关卡就被拦下了,在雪地里等了将近40分钟,才搭上计程车。
辩护律师王宇:“我们被他们设定的关卡给扣住了,把我身份证扣下了,又把司机也扣了,把车也扣了,让我们在他那边设立关卡站,先是在里边等,然后把我们撵出来,室外是大雪,零下30多度。等了大概有40分钟,当时把我们车扣了以后,有一辆大巴往那边去,我们要上大巴,他们局长不让那个车拉我们。”
随后,王宇律师在微信上透露,他们在第二道关卡又被拦了10多分钟,计程车到了法庭门前也不让过,绕行了一大圈路,约有2、3公里才进入法庭,那时已经10点多了。
据社交媒体消息,为了阻止民众前往法庭旁听或作证,一些建三江居民家前后门甚至被当局用铁链锁住。当事人石孟文的家属在第一道关卡被非法拦截。石孟文的哥哥和姐姐身为黑监狱受害人,本想到法庭当庭作证,也分别被阻隔在法庭之外或禁闭在家。而当事人孟繁荔唯一的姊姊和两位陪同朋友,也在法庭前被警察劫持到派出所。
王宇:“所有的过的车辆,他都要检查,身份证各方面的、司机的情况,人员的讯息都检查。据说昨天晚上已带走不少人,来旁听的都给抓回去了。”
维权律师唐吉田:“今天他们的行为印证了在农垦系统,特别建三江这个地方,他们长期以来侵犯人权的一些事实。但不管怎么说,有8、9位律师在前方克服各种困难,去为受害者辩护,包括受害者家属在内的各方面人士也积极的去行使权利,让他们感觉到紧张和惊慌,说明正义的力量在增长。”
17号中午11点50分,辩护律师王全章发出微博,指出律师们在庭前会议中,发现石孟文穿着单薄的囚衣和拖鞋,说看守所不让穿棉衣。王律师痛批,建三江的户外气温达零下30度,他们穿着厚厚的棉衣都感觉冷,“建三江看守所毫无人性人道!”
辩护律师刘连贺:“四名被告人情绪还行,只是在下午休庭的时候,应该是李桂芳,因为她年岁大了一点,她就有高血压的情况。再有呢石孟文开庭的时候只穿着单衣服,后来我们跟审判长交涉,下午开庭的时候给他买了军大衣,看守所好像都不让穿棉衣,不是针对他。”
辩护律师刘连贺告诉《新唐人》,下午1点才开庭,休庭了4、5次,庭审大约在5点半结束,18号早上还要开庭审理。
刘连贺:“他程序就是全部违法的,中间休了(几次),我们老是申请让他们回避嘛,也提出了抗议,他老想把法庭开下去,我们就不答应他。他列了7项证据,最后一个是处理法轮功的案件的会议精神那么一个证据,他隐密了,他觉得那肯定是不合适的,公诉人在念起诉书的时候,他把那个给舍去了,我们就不答应,迫使他休庭了。”
刘连贺律师透露,他们在回家的路上,也被拦下接受检查。
刘连贺:“就是专门盯着我们两辆出租车,两辆出租车一直在庭外等着我们,等了一天,我们启动以后,警察可能把车号告诉前面的关卡,就给我们拦下来,拦下来以后还是查身份证,后来王全章律师在给他们录像的时候起了争执,把手机给抢走了,后来经过交涉,把手机还给我们了。”
刘连贺律师表示,法院说明天早上9点半还要开庭,但能否真的开庭,开了庭以后,如果传证人到庭,当局能不能让这些人来,都是个问题。

Checkpoints Block Defending Lawyers in Jiansanjiang
Nine months have passed since the Jiansanjiang Incident
drew attention from the world.
Currently, there are still 4 Falun Gong practitioners illegally
detained there.
Finally on Dec.17, their cases came to a court trial.
However, for those who went to sit in or testify in the trial,
Jiangsanijang’s local police had massively detained them
or held them at home.
The police also set several checkpoints in an attempt
to stop 8 defending lawyers attending the trial.
In the Jiansanjiang Incident, 7 Falun Gong practitioners
were abducted and persecuted along with justice lawyers.
Currently, four of them are still in illegal detention.
They are Shi Mengwen, Meng Fanli, Wang Yanxin
and Li Guifang.
The Chinese Communist Party (CCP) has deferred the court
trial several times, being fearful of the huge impact
of the Jiangsanjiang cases.
On the morning of Dec.17, many mainland netizens began to
update news about Jiansanjiang on Weibo or WeChat.
The trial began at 9 am, and a large group of special police
were guarding the roads into and out of the court.
There are 8 defending lawyers for the trial.
They are Wang Yu, Lin Qilei, Wang Quanzhang, Tang Tianhao,
Chen Zhiyong, Zhang WeiYu, Xi Xiangdong and Liu Lianhe.
Four of them, including Wang Yu and Lin Qilei, as well as
a lawyer with them to sit in the trial, were blocked
on their way to the court.
Lawyer Wang Yu said, Jiangsanjiang authority had set up
three checkpoints.
They were stopped at the first one, and had to wait for
nearly 40 minutes in snow before getting in the taxi.
Wang Yu, defending lawyer: “We were stopped at
the checkpoint.
They took away my ID, and kept our driver and the car.
In the beginning, we are told to stand inside the checkpoint.
Then we were driven out of the room and had to
wait outdoor in the snow.
The temperature was minus 30 C.
At that time, a bus passed the checkpoint in the direction
of the court.
We intended to get on that bus but the checkpoint director
did not allow the bus to take us."
Shortly afterwards, Wang Yu wrote on WeChat that they
were again delayed at the second checkpoint for
over 10 minutes.
The taxi was also blocked at an entrance to the court.
They had to travel for another 2 or 3 kilometers.
It had been after 10 am when the lawyers finally
arrived at the court.
According to social network updates, Jiangsanjiang’s
authority had sealed off doors of local residents
with iron chains, so as to prevent them from sitting in or
testifying in the trial.
One of the litigants Shi Mengwen’s family members were
also blocked at the first checkpoint.
Shi’s elder brother and elder sister had planned to testify
in the trial, as they were also victims of the black prison.
Both of them were either blocked or held at home
by the local authority.
Another litigant Meng Fanli’s only sister and two friends
were also abducted by police before the trial.
Wang Yu:"They are inspecting all passing vehicles, collecting
information about identities of drivers and passengers.
It was said that many people had been detained and
sent back home last night."
Tang Jitian, defending lawyer: “What they did today confirms
that in the CCP’s farming system, especially at Jiansanjiang,
there have long been serious violations of human rights.
On the other hand, 8 or 9 lawyers had overcome
all difficulties to defend the victims.
Families of litigants were also actively exercising their
basic rights.
All these make the CCP authority more nervous and
frightened, suggesting how the power of justice
begins to dominate."
At 11:50 am of the day, defending lawyer Wang Quanzhang
revealed on Weibo that, lawyers found Shi Mengwen
only wore thin prison uniform and slippers.
Shi said the detention center did not let them wear
cotton-padded jackets.
The outdoor temperature was minus 30 C and lawyers
still felt cold in very thick jackets.
Wang thus said “Jiansanjiang detention center definitely
has nothing called humanity!"
Liu Lianhe, defending lawyer: “The four litigants looked
pretty calm.
I think it was Li Lianfang that showed hypertension in
the afternoon break as she is older.
In addition, Shi Mengwen only wore thin clothes at
the beginning of trial.
We negotiated with the chief judge, and bought him
a military coat.
It seems that the detention center there does not
let prisoners wear coats."
Liu LIanhe told NTD that, the court had adjourned
4 or 5 times on the day.
The trial ended at about 5:30 pm, and will reopen
the next morning.
Liu Lianhe: “The whole trial followed unlawful procedures.
There were several breaks as we protested many times.
They tried to move forward but we won’t accept.
They listed 7 pieces of evidence.
Among them the last one is a so-called conference
decision on tackling Falun Gong cases.
They did not mention this one as they must also
think that is improper.
The procurator skipped that part when reading
the indictment. Of course we won’t accept this
so the court was forced to take a break."
Liu Lianhe also said, lawyers were again stopped
and inspected on their way back.
Liu Lianhe: “Two taxis had been waiting outside the court
for the whole day.
After we left, probably the police contacted the checkpoint
and told them the taxis’ number-plates.
We were blocked there and they again checked our ID cards.
Wang Quanzhang videotaped what they did
and there was a dispute.
They took away his cell phone but later
returned it to us after negotiation."
Liu Lianhe said, the court stated the trial would reopen
at 9:30 am the next day.
However, it is still unclear whether the trial will be able to
reopen, and whether the CCP authority will allow witnesses
to give testimony.
