【禁闻】中国首个宪法日 官热民冷

【新唐人2014年12月06日讯】12月4号是中国首个宪法日,中共党媒推出宪法日专题,各级法院、检察院也在官方微博发布司法人员举行宣誓仪式,或者普法活动等消息。但一项民调显示,只有8.8%的中国人完整读过宪法。评论指出,主要原因是当局不依法办事,导致人们不相信宪法,蔑视宪法。

11月1号,中共人大常委会通过了关于设立中共宪法日的决定,把每年的12月4号定为中国宪法日。

宪法日当天《人民日报》、《央视》等中共喉舌纷纷在微博上刊发《宪法》条文,各地各级法院、检察院的官方微博,也在发布司法人员举行宣誓仪式或普法活动的消息。

《新华社》则在头版推出宪法日专题,强调中共总书记习近平关于宪法的一些讲话,包括所谓的依法治国的关键是依宪治国,依法执政的关键是依宪执政,任何组织和个人都不得超越宪法之上等。

宪法日前夕,广东律师王全平在网路上发起建立“违宪审查制度”联署活动。王全平表示,中国虽然有宪法,但距离真正落实宪法,推动宪政还很遥远,直到目前,中共的一个内部文件,一个电话都可以超越宪法之上。

广东律师王全平:“把12月4号定为宪法日,还要公职人员入职的时候对宪法进行宣誓,这都是形式上的东西,因为违宪的事例太多了,已经是数不胜数的,全国人大常委会到目前为止,都没有启动过对一起违宪事件的审查,等于宪法没有用。”

陆媒在宪法日推出的一项针对52007名中国人,对宪法了解程度的调查发现,只有12.7%的受访者表示了解宪法赋予公民的基本权利,8.8%的受访者完整读过宪法文本。

原山东大法教授孙文广表示,中国人不关心宪法,根本原因是最初制定的宪法很荒谬,后来虽然经过了4次修改,有了一些正确内容,但当局从来不依照宪法办事。

原山东大法教授孙文广:“后来我写了一些文章,对宪法提出修改意见提了很多,2000年的时候我在香港出了一本书,这本书叫《逆风33年》,这里主要就是批判中国共产党制定这个宪法,它里面有哪些荒唐、哪些错误。”

孙文广介绍,中共从1954年至今,已颁布了4部《宪法》,过去的宪法中,甚至出现必须拥护共产党的领导等荒唐内容,后来经过了1988年、1993年、1999年和2004年的4次修正。

孙文广:“宪法经过它历次的修改,它也为了装点门面,它也有些正确的内容,就是公民有言论、出版、结社、集会、示威的自由,这些很管用,大概是35条,但是这些条数共产党又不兑现,很多人因为发表一些正确的言论,批评共产党的言论,被抓起来,被定上煽动颠覆国家政权罪,所以人们对这个宪法抱着轻蔑的态度。”

近年来,无数敢言人士因发表批评中共或中共不喜欢的言论被抓捕,自中共十八大掀起“反腐”运动后,更有不少民众因配合反腐,在网络举报贪腐官员,或上街举牌要求官员财产公示,遭到抓捕关押。

就在宪法日的前一天,上海数千访民到上海市人民广场拉横幅,要求当局真正依照宪法行事,归还公民基本人权,却遭到警方驱赶、抓捕和殴打。

上海访民孙洪琴:“政府没有宪政、法制,如果真正的政府做到了宪政、法制,法院真正的依法了,司法公正了,那么这么多冤民,这么多有诉求的人,他们不可能求告无门。我们的要求就是说改变政治体制,改变政府的执政方式。”

宪法日当天,中国各地大批访民涌入北京,被警察拦截抓捕,数千名访民被送往久敬庄等地关押。黑龙江省的7名蒙冤警察,在北京中南海门前伸冤遭到镇压后,喝毒药自杀。

孙文广表示,对访民大肆抓捕、关押,再次证明中共所谓的“依法治国”,只是它愚弄民众的一个道具。

China Holds First Constitution Day,
People Show Less Faith Than The Authority

Dec. 4 is China’s first Constitution Day.

The Chinese Communist Party (CCP) media promoted
Constitution Day theme programs.
All courts and procuratorates also published information
on official Weibo accounts that judicial officers hosted
swearing-in ceremonies and other law promotion activities.

But an opinion poll shows that only 8.8% Chinese citizens
have read the complete constitution.
Commentary says the main reason is that the authority
doesn’t act according to the law, which caused the people not
to believe in the Constitution and
even disdain the Constitution.

On Nov. 1, the Standing Committee of the National People’s
Congress decided Dec. 4 to be the Constitution Day.

On Constitution Day, the CCP mouthpiece People’s Daily
and the CCTV etc. all published articles of the Constitution.
All levels of courts and procuratorates also released news
about judicial officers participating in
swearing-in ceremonies and other law promotional activities.

Xinhua published the Constitution Day theme topic
on the front page.
It underscores the CCP general secretary Xi Jinping’s speech
over the Constitution.
The key to the rule of law is to rule according to the
Constitution, to govern according to the Constitution, and no
body or organization can be above the Constitution.

Before Constitution Day, Guangdong lawyer Wang Quanping
initiated a petition on the internet,
urging to establish “unconstitutional censorship.”

Wang indicated that although China has a Constitution,
it’s far away from truly implementing the Constitution.
It’s still a long way away from promoting constitutionalism.

Even nowadays, a document or a phone call inside of
the CCP can overpower the constitution.

Wang Quanping, lawyer in Guangdong Province:
Making Dec. 4 to be the Constitution Day and requiring
public officials to take oaths to the Constitution before entry
are all superficial formalities.
There have been too many cases against
the Constitution, countless.
The Standing Committee of the National People’s Congress
hasn’t investigated any unconstitutional case,
which leaves the Constitution having no use.

Mainland media promoted a poll that has 52,007 Chinese
respondents, to show how well people know the Constitution.
The result shows only 12.7% of the people know about
the basic rights guaranteed by the Constitution, and
8.8% of the people have read the complete Constitution.

Former Shandong University law professor Sun Weiguang
says the root reason why Chinese don’t care about the
Constitution is that the original Constitution was ridiculous.

Although it contains some correct content after four rounds
of modification, the authority has never acted
according to the Constitution.

Sun Weiguang, former law professor at Shandong University:
I wrote some articles, raising many suggestions for
modifying the Constitution.

I published a book ‘Against the Wind for 33 Years’ in
Hong Kong in 2000, mainly criticizing the Constitution made by
the Chinese Communist Party, the ridiculous content
and the mistakes it had.

Sun says the CCP has issued four Constitution since 1954.

In the old Constitution, it even had ridiculous content
such as the CCP must be supported.
The Constitution was modified four times
in 1988, 1993, 1999, and 2004.

Sun Wenguang: After several modifications, also to make
it look better, it has some correct content, such as citizens
have the freedom of speech, press, association,
assembly and demonstration.
These are useful.
There are about 35 such articles.
But the CCP doesn’t observe the Constitution.

Many people have been arrested due to publishing speeches
criticizing the CCP, and some were charged for
‘inciting subversion of state power.’

Thus, people have the attitude of disdaining the Constitution.

Many outspoken people who stated speech criticizing the CCP
or unfavored by the CCP have been arrested in recent years.
Since the CCP started the anti-corruption campaign, many
people have reported official corruptions on the internet,
or protested to request officials to open properties.

And many of those people have been detained.

Thousands of petitioners put up banners at the People’s
Square in Shanghai on the day before the Constitution Day,
urging the authority to act according to the Constitution
and to give basic human rights back to the citizens.
But they were expelled, arrested, and beaten by police.

Sun Hongqin, petitioner in Shanghai: The government doesn’t
have the Constitution and rule of law.
If the government truly acted according to the Constitution
and rule of law, if the court and judicial system were just,
so many people with grievances would have a way
to solve their problems.
Our request is to change the political system,
to change the way of government’s ruling.

On Constitution Day, mass protesters throughout the country
came to Beijing, being stopped and arrested by police.
Thousands of petitioners were sent to Jiujingzhuang
detention center in Beijing.
Seven laid off police from Heilongjiang Province were
suppressed when they tried to express their grievances
in front of Zhongnanhai in Beijing.

They then attempted suicide by drinking pesticide.

Sun Wenguang indicated that arresting and detaining
petitioners once again proved that the so-called “rule of law”
is just a tool of the CCP to fool the people.
