【新唐人2014年04月02日讯】中共军方原总后勤部副部长谷俊山，日前被正式提起公诉。有“军中第一贪”之称的谷俊山，将上军事法庭受审，审判过程不予公开。官方媒体高调宣称为刮“谷”疗毒的中共军队点“赞”，而民间对此不以为然。让我们一起去听听专业人士的看法。
大陆媒体3月31号傍晚宣布：中共军方原总后勤部副部长谷俊山，因涉嫌贪污、受贿、挪用公款、滥用职权等，由军事检察院在当天向军事法院提起了公诉。
随后，中国各大媒体爆炸式的报导有关谷俊山的文章。英国广播公司《BBC》中文网预告，军事法庭审理谷俊山的过程并不公开，但判决结果将公告。
大陆律师魏汝久：“谷俊山他案发之前是现役的军人。他的犯罪也涉嫌到部队建设当中的一些问题，按照中国的《刑事诉讼法》就应该以军事检察院来侦查，向军事法院来提出。军队的案子，一般情况下是公开，但是如果涉及到军事机密就不公开。 ”
有过军旅经历的北京市“杰睿律师事务所”律师刘昌松，在他的博客表示：谷俊山案由中共军方的军事法院一审，而不是由军方直属队的军事法院一审，这是相当高规格的管辖。
据报导，谷俊山从2012年就被调查，去年1月12号深夜，他在河南的老家被抄，各种财物装了4卡车。其中包括“一帆风顺的大金船”、“金玉满盆的金脸盆”和纯金毛泽东像等。另外，谷俊山在北京二环黄金地段的地产有数十块，拥有几十套房子﹔在上海，他还参与土地和楼盘的买卖等。
有报导说，谷俊山贪腐达200亿元人民币，因此谷俊山被媒体冠以“军中第一贪”。民间也流传着很多他和女明星淫乱的丑闻，其中流传最广的是，他曾说过“中国的女星我都玩腻了。”
有媒体评论，谷俊山难逃死刑。
4月1号中共党媒《人民网》高调发文，要大家不能用谷俊山这个微不足道的一个人，去否定中共整个军队，恰恰相反，还要点赞中共军队。大量媒体转发了这篇文章。
大陆维权律师刘士辉：“其实就是切割，把谷俊山从军方给切掉。这种做法是很弱智的，军队是各个系统中最腐败的重灾区。现在都已经烂透了，大家都在忙着弃船。他们担心，意在安抚人心，意思就是说已经曝光了这些就是彻底的腐败份子了，其他的都是好的。”
2012年，在“王薄事件”前期，就有消息说谷俊山被调查，他的后台是原中共党魁江泽民办公室的主任贾廷安，分析认为，谷俊山的倒台，是中共新任高层对江派军中残余的进一步围剿。
大陆《财新网》，两年来接连发表特稿，包括“谷俊山之弟谷三的王国”、“谷俊山的‘红色血统’”、“谷俊山的河南将军府”、“谷俊山崛起之路”、“总后副部长谷俊山被查已有两年”等。
香港《明报》评论文章说：习近平在外国访问期间公布“谷俊山被提起公诉”的消息，是“刻意彰显习对军队控制之稳固”。
刘士辉：“它现在就是想什么刮‘谷’疗毒，你就是放疗、化疗都没有用了，都已经彻底的病入膏肓了。真正想来根治腐败问题，必须是从制度上来说。制度不改变的话，没可能根治腐败这个顽疾。就算到了世界末日，他们也不会从制度上入手，所以是无解的。”
现年58岁的谷俊山2003年晋升为少将，2009年升任总后勤部副部长，2011年获得中将军衔。2012年被查，同年2月被撤职。据报导，发起扳倒谷俊山的是﹕中共前国家主席刘少奇之子、总后勤部政委刘源。并且是在时任军委副主席的习近平支持下，获得当时中共国家主席胡锦涛的同意。

Gu Junshan Will be Tried by Military Tribunal – Will
Scraping Him Cure the Poison?
The former deputy logistics chief Gu Junshan has been
formally prosecuted.
The No. 1 military corrupt Gu Junshan will be handed over to
a military tribunal for a closed trial.
The party media gave it a high-profile and enthused about
scraping Gu to cure the poison; but the citizens don’t accept it.
Let’s look at this news in more detail.
On March 31, mainland media announced the former deputy
logistics Chief Gu Junshan received a summons to military
court by the Military Prosecutor’s Office acused of abusing
power, corruption, bribery, embezzlement, etc.
Subsequently, China’s major media explosively reported
articles about Gu Junshan.
The UK BBC Chinese website reported that Gu Junshan’s
military hearing will not be public, but the verdict will be.
Mainland lawyer Wei Rujiu: “Gu Junshan was an active duty
soldier before the incident.
His crime was suspected to be some of the problems of army
construction.
According to the China Criminal Procedure Law, the military
procuratorate should investigate and send it to military court.
The army’s case is normally open but will be closed if related
to military secrets."
Lawyer Liu Changsong from Jay Herrington & Sutcliffe LLP,
blogged: “The case is at Dragon Hill Valley Chinese military
court rather than at a standard military court as usual.
The case coming directly under the military team, is quite a
high level jurisdiction."
It is said that Gu Junshan was investigated since 2012.
On January, 12, 2013 his Henan home and all his properties
contained four trucks. There was a golden boat symbolizing
things going smoothly, a golden wash bowl meaning Gold
and a pure gold Mao Zedong Statue.
Gu also has multiple real estate and dozens of houses
at the golden section of Beijing, second ring.
He also had real estate in Shanghai.
Some reports said Gu Junshan’s corruption reached 20 billion
yuan and was known as the No. 1 military graft.
There are stories of his adulterous scandals and the most often
heard phrase from him was: “I am tired of Chinese actresses".
One media said Gu Junshan may not escape the death penalty.
On April 1, the Chinese Communist Party (CCP) mouthpiece
People’s Daily said an unimportant Gu Junshan cannot be used
to deny the entire CCP army; on the contrary, the military
should be praised. Many media forwarded on the article.
Mainland human rights lawyer Liu Shihui: “it’s actually a way
to separate Gu Junshan from the military.
It is backwards because the military is rotten and most corrupt
in the various systems, so everybody is busy trying to escape.
They intend to appease the people by saying the exposed are
completely corrupt and those remaining are good."
In 2012, before the Wang Bo event, apparently Gu Junshan
was investigated and his background contained former CCP
leader Jiang Zemin office’s director Jia Yanan.
It is analyzed that Gu Jun Shan’s sacking is a further way to
purge Jiang faction military leftovers from CCP new leaders.
Mainland Caixin website published special articles in recent
two years including:
Gu Junshan’s brother Gu San’s Kingdom; Gu Junshan’s red
blood; Gu Junshan Henan general government;
The rise of Gu Junshan; Two year investigation into deputy

Hong Kong Ming Pao commentary said: Xi Jinping allowed
news of of Gu Junshan’s prosecution to show he is firmly in
control of the military.
Liu Shihui: “They are trying to scrap Gu to cure the poison;
however, even radiotherapy and chemotherapy are useless
against such serious sickness.
The only way to cure the corruption is to change the system;
otherwise there is no possible to cure.
However, even until the end of the world, they won’t do it
from within the system."
58-year-old Gu Junshan was promoted to major general in
2003; then deputy minister of General Logistics Department
in 2009 and the rank of lieutenant general in 2011.
He was investigated in January 2012 and dismissed in
February 2012.
According to reports, it was former CCP state president Liu
Shaoqi’s son, Liu Yuan who launched the campaign to pull
down Gu Junshan.
It was with the support of the Central Military Commission
Vice-President Xi Jinping and agreed by Chinese President
Hu Jintao.
