【新唐人2013年06月19日讯】最近几年,中共官员因为“双规”而死亡的案例,频频被曝光。虽然许多民众认为,被“双规”的官员死有余辜,但“双规”的隐秘性和合理性,再次被外界质疑。有律师认为,这是中共为了维护自身统治利益和地位,独创的一种党内“私刑”制度。让我们的记者来为您揭开“双规”的黑幕。
“双规”,是指共产党党员在接受检察机关调查前,在中共党内被限制人身自由的一种隔离审查。
现任湖北省黄梅县地震局局长的钱国良,被中共“双规”56天后,疑遭刑讯逼供,导致多器官功能性衰竭,陷入深度昏迷。
钱国良的太太王七珍不敢相信,自己的丈夫被带走时还是个健康的人,现在却深度昏迷。
《新唐人》记者:“您先生现在的身体是否有起色?”
湖北黄梅县地震局局长钱国良太太王七珍:“ 还没有。”
记者:“现在还在医院吗?”
王七珍:“对。等一下医生又要讲那个病情。”
“双规”要求违纪的中共官员,在规定的时间和地点,接受中共纪检委调查。过去10年,数以百计的中共官员在恶劣的监禁环境中,有的自寻死路,有的神秘死亡。
今年4月9号凌晨,温州市工业投资集团党委委员、总工程师于其一,被“双规”38天后死亡。网络有照片显示,于其一全身多处瘀血,家属质疑遭到刑讯逼供。
4月23号,河南省三门峡市中级法院副院长兼执行局局长贾九翔,被当局“双规”10天后死亡。家属表示,他的遗体面部等多个部位肿胀发紫,有“明显有被殴打的痕迹”,家属质疑是遭酷刑而死。
1998年,中共中纪委、监察部规定,“双规”场所不能设置在司法机关的办公、羁押场所,和行政部门的收容遣送场所。于是,酒店、招待所,都可能成为“双规”的场所。
如果说,“双规”是中共党内组织所谓的家法,那么当官员贪污犯罪时,首先不是由国家的法律制裁,而是由中共当局先闭门处理后再说。
大陆律师李天天:“我觉得这符合他们高层的利益,因为每一个官员都腐败,不是单独存在的,都是跟上级官员、下级官员勾结在一起的,所以他们每要处理一个干部的时候,他们就要先内部考量一下,应该怎么处置?这个人有什么对上级不利的,首先他们要了解这个人的犯罪性质是否危及到了上级,然后他们才决定怎么样处理。”
大陆律师李天天表示,具有中国特色的“双规”完全没有合理性,在缺乏法律依据之下,单凭共产党的内部条例就可以限制人身自由,中共党内条例逾越法律。
李天天:“双规简直是超越了法律,法律之外的黑帮自己内部的规定似的,因为按法律,你要对一般人进行强制措施的话,必须由公检法来执行,执法部门来执行,现在是这个纪律检查委员会,然后就控制一个人的自由,然后就可以任意进行审讯调查。”
李天天还表示,对公务员的调查应该是检察院的责任,现在是由中共内部自行处理,完全超脱法律之外,不符合法制的调查手段。
李天天:“这就说明在这个国家,犯法是明目张胆的事情,犯法的事情反而变成合法的事情,只要这个党说了算,权力完全大于法律了,那法律很多规定都是空文,法律架空了,这个政府绑架了法律,也绑架了老百姓,没理可讲。”
《纽约时报》2012年6月曾经报导,浙江一位亲身体验过“双规”的官员透露,“双规”过程中,他被人拿天线鞭打,连续12天不能睡觉,以致产生幻觉,最终在身心极度疲乏的情况下,违心的接受所有子虚乌有的供词。

Growing Number of Chinese Communist Officials Die Under Party Investigation
In recent years, China has seen a growing number of
deaths of Chinese Communist Party (CCP) officials,
who were under investigative detention (Shuanggui).
Meanwhile, the secrecy and legitimacy of
Shuanggui has again raised public concerns.
Lawyers say this is the Party’s “lynch law”,
designed to maintain CCP political rule.
Let’s investigate further.
The term “Shuanggui” refers to a CCP member being
placed under investigative detention by the Party.
This occurs before he faces any legal action.
Qian Guoliang is the current director of the Earthquake
Administration of Huangmei County, Hubei province.
Qian is now in a deep coma,
after 56-days of Shuanggui.
It is suspected that he was tortured,
leading to his organs shutting down.
Qian Guoliang’s wife, Wang Qizhen, is finding it
hard to come to terms with the fate of her husband.
NTD reporter: “Has your husband’s health improved at all?"
Wang Qizhen: “Not yet.”
NTD reporter: “Is he still hospitalized?”
Wang Qizhen: “Yes, I’m now in the hospital. The
doctor will tell me about his situation in a while.”
CCP officials under Shuanggui are required to
confess their disciplinary violations within the
specified time frame, and at a designated venue.
Reportedly, over the past 10 years, harsh imprisonment
has caused the deaths of hundreds of CCP officials.
On April 9, Yu Qiyi, CCP member and chief
engineer of Wenzhou Industrial Investment
Group, died after 38-days of Shuanggui.
The pictures released on the internet show that
many blood stains are clearly visible on his body.
His family members suspect that Yu had been
tortured before his death, to extract a confession.
A similar incident occurred on April 23
in Sanmenxia, Henan Province.
Jia Jiuxiang, Vice-President of the municipal intermediate
court, died after going through 10 days of Shuanggui.
His family members have said that Jia’s
body had “obvious signs of being beaten”.
There were several swollen purple-blue parts on
his face. They believe that Jia died under torture.
In 1998, CCP Central Commission for Discipline Inspection
(CDIC) and the Ministry of Supervision gave instructions.
Judicial offices, places of judicial custody,
places of administrative custody and
repatriation cannot be used for Shuanggui.
Since then, hotels and guest houses
have become Shuanggui venues.
Shuanggui is known as the CCP’s internal punishment.
Any CCP official who is accused of corruption will be
firstly handled inside the CCP before facing legal action.
Li Tiantian, lawyer in China: “This practice
is in the interests of the CCP’s ruling elite.
The fact is that all the CCP officials are corrupt.
Their corruption is not isolated, but created by
collusions with their superiors and subordinates.
So each corruption case would firstly go
through the Party’s internal processing.
They would consider whether the charged
official has evidences against his superiors.
The decision of how to handle the official would
be finalized only after they find out how much
the charge may jeopardize his superiors.”
According to Li Tiantian, Shuanggui is legally groundless.
In China, personal freedom can be easily restricted
by CCP Party regulations, which overrides the law.
Li Tiantian, lawyer in China: “Shuanggui
has simply bypassed the law in China.
It equates to an internal discipline of a mafia gang.
Legally, only the police organs and judicial departments
have the authority to take compulsory measures against
a suspect, but now it’s the also CDIC playing this role.
It can restrict a citizen’s freedom at will
by detaining and investigating him.”
Li Tiantian further highlights that the Procuratorate
has duties to investigate suspected civil servants.
But in reality, it is internally conducted by the CCP,
which is completely outside and against the law.
Li Tiantian: “This illustrates that in
China, they blatantly break the law.
Party power has completely overridden the laws, making
lots of laws and regulations merely be scraps of paper.
The CCP regime has kidnapped the law
and the populace, and is without reason.”
In June 2012, the New York Times reported on a
Zhejiang official, who had been subjected to Shuanggui.
Reportedly, he was whipped with a TV antenna and
kept awake for 12 days until he began to hallucinate.
“In the end, I was so exhausted. I agreed
to all the accusations against me even
though they were false,” said the official.
