【新唐人2013年02月08日讯】云南省政法委书记孟苏铁日前宣布，将统一停止三种行为的劳教审批，包括涉嫌危害国家安全、缠访闹访、和丑化领导人形象。并且，暂停其他违法情形的劳教审批。孟苏铁强调，目前的在押人员继续执行。此外，不受理历史遗留问题，确有执行错误的，按个案处理。
《云南日报》的晚刊《春城晚报》，报导了“云南暂停省内全部劳教审批 ”的消息。在云南全省政法工作会议上，政法委书记孟苏铁指出，从现在起，对涉嫌危害国家安全、缠访闹访、丑化领导人形象等三种行为的劳教审批统一停止。报导宣称，云南省政法工作会议上的“暂停劳教”决定，是对全国政法工作会议的贯彻与落实。并提到了三个典型的劳教案：唐慧案、任建宇案、及彭洪案。
美国“哥伦比亚大学”政治学博士、时政评论家李天笑表示，这三种行为也没有包含在50年代的劳教制度范围内，消息让人一看，就觉得非常不合理，很荒唐。
时政评论家 李天笑：“把这三项列出来以后，我想它的一个主要目地就是说，平息民众的矛盾，缓解民众的矛盾，再有一点就是，把一些比较出格的、非常极端的这种行为，把它排除出这个劳教制度之外，作为一个修正。”
原“北京凯泰律师事务所”律师金光鸿也认为，废除劳教制度，是中共在国内外形势的压力下，迫不得已作出的一个决定。金光鸿指出，劳教制度不管从普世价值来讲，还是从中共本身的法律来讲，都违法。
原北京凯泰律师事务所律师 金光鸿“我认为不能说是一个法治的进步，也不能说是一个法治的胜利，它就是压力太大了，它作出的一个让步，你真正法治的话，你司法要独立。”
报导强调，其他违法的情形，依据相关法律进行处理，不再采用劳教手段。
李天笑认为，暂停的本身，就包含着探路的成分。
李天笑：“来试探试探民众对这个问题的看法如何，想为自己留一条尾巴，留条后路。在这个同时，我估计，他现在也在准备一个替代的方案，替代的机制，暂停的意思就是随时可以恢复，所以说，如果找到了一个替代的方案，比方说原来就搞过违法行为矫正法。”
中共政法委书记、公安部长孟建柱，1月7号在全国政法会议上宣布，今年将“停止劳教制度”，不过后来中共的官方媒体又改口说，只是“改革”劳教制度。国际特赦组织与学者都提出，“慎防中共换汤不换药，变相延续劳教。”
稍早前，法律界和学术界对所谓的《违法行为矫正法》代替劳教制度，就存有争议，分析指出，这个所谓的新法，目地不纯，是更进一步的换汤不换药。而且到现在也没有出台。
此外，孟苏铁还特别强调，目前在押人员采取继续执行自然消化的态度，原则上不受理历史遗留问题，确有执行错误的，按个案处理。
李天笑：“ 从99年以来，中共的劳教制度，在江泽民和后来的周永康等这些人掌握之下，成了关押法轮功学员的一个最大的集中营，一旦启动对劳教制度的反省，这就必然牵扯到这些法轮功学员怎么办，因为他们完全是无罪关起来的，谁下命令把他们关起来的，什么原因把他们关起来的，这对他来说是非常困难的一种解释。”
李天笑指出，中共目前既不想触动劳教制度的本身，他又想平息高涨的民愤。所以，现在把这个问题推出来作为一个试点，看看社会的反应。李天笑表示，不解决法轮功的劳教问题，中共还将面临巨大的冲击。

Yunnan Suspends Approval of Labor Camp Punishment but Won’t Release Detainees
Meng Sutie, the secretary of Yunnan Provincial Politics
and Law Committee announced recently that they will stop sending three types of criminals to labor camp,
This will include those charged with endangering state
securities, irrational petitioning and defaming leaders’ images.
Other labor camp punishments will stop as well.
Meng Sutie emphasized that those current detainees
will continue to complete their labor reeducation.
In addition, the wrong punishments without
complications will be dealt with case by case.
Chuncheng Evening Paper, the evening edition of
the government operated Yunnan Daily reported the news
“Yunnan Suspends All Punishments to Labor Camp”.
It reported that in the political and legal work meeting of
Yunnan province, Meng Sutie, the secretary of Politics and Law Committee said:
“From now on, the labor reeducation punishments for
those accused of endangering state securities,
sentences for those charged with irrational petitioning,
and with defaming leaders’ images are suspended.”
The report said the decision to “suspend the labor camp
punishment” is a result of the National Politics and Law meeting.
The report also mentioned three typical cases: the
Tang Hui case, Ren Jianyu case and the Peng Hong case.
Li Tianxiao, political commentator, a Ph.D. in political science
of Columbia University said that these three actions are not included in the definition of Labor reeducation law.
This news looks very unreasoned and ridiculous.
Li Tianxiao: ”One of the main purposes of listing the three
types of actions is trying to erase the contradictions.
In official statements that are confusing people.
Another point is it’s a kind of amendment that
excludes these actions in labor reeducation.”
Jin Guanghong, the former lawyer of “Beijing Kaitai Law Firm”
also thought the abolition of the labor reeducation system is an action that the CCP had been forced to take.
This being because of mounting pressure from
inside and outside of China.
Jin Guanghong pointed out that the labor reeducation
system is illegal by both universal values and CCP’s laws.
Jin Guanghong: ”I think it can’t be treated as either
progress in rule of law, nor a success in rule of law.
It’s simply a concession because the pressure is too much.
If it really wants to rule by law, then the judicial
system should be independent.”
The report stressed that other criminals will be dealt with
by relative law, and labor reeducation will no longer be used.
Li Tianxiao thinks this suspension is an attempt
at sounding out opinion and the reaction.
Li Tianxiao: ”(It’s the CCP) testing what’s the people’s opinion
on this issue, and trying to leave a way out for itself.
At the same time, I guess it has an alternative solution.
The definition of suspending is that it can restart at any time.
So, it has found some alternative solutions, for example,
it raised Correction Action on Illegal Acts before.”
Meng Jianzhu, the secretary of Politics and Law Committee
announced at the national Politics and Law meeting
on January 7 that he will stop the labor reeducation this year.
However, CCP official media changed the words later and
said it’s a reform of the labor reeducation system.
Amnesty International and some scholars have raised
several questions:
“Be careful and aware that the CCP may use another term and
method to continue the labor reeducation system.”
A few days ago, the legal profession and academia expressed
different views on the replacement of labor reeducation system by so-called “Correction Action on Illegal Acts”.
They analyzed that the purpose of the so-called New Law
isn’t positive, which can be further treated as changing the water but not changing the medicine.
The Act hasn’t been released until now.
In addition, Meng Sutie stressed especially that the
current detainees will be treated by natural digestion.
In principle, their cases won’t change the sentence even
with complications, unless there’s an error in execution.
Then the case will be dealt with as an individual one.
Li Tianxiao: “From 1999, CCP’s labor reeducation system
was controlled by Jiang Zemin and later Zhou Yongkang
and has the biggest concentrated camps full of
Falun Gong practitioners.
Once launched, a reflection on this system, must face
the issue of how to deal with Falun Gong Practitioners.
Because all of them are innocent but detained. It’ll be hard
for the CCP to explain who recommended detention?
What’s the reason for the detention?
It’s hard for them to explain.”
Li Tianxiao pointed out that now the CCP doesn’t want to
change the labor reeducation system, but wants to calm people’s grievances and their reactions.
It is using this issue as a litmus test to see
what kind of feedback it will get from society.
Li Tianxiao said the CCP will face a huge backlash if it
doesn’t solve the issue of the labor reeducation of innocent Falun Gong practitioners.
