【新唐人2013年01月30日讯】山东公安厅的“2013年01号机密文件”中指示,对所谓地下邪教组织、茉莉花行动组织、和法轮功组织成员可以先抓捕、羁押,再补办手续和审讯。这种严重违反《宪法》和法律的行为,对中国还抱有“宪政梦”的广大民众,无疑又是当头一棒。
匿名人士曝光了这份机密文件,并且表示:“使更多的人免于被伤害,也算对得起自己的良心!”
被曝光的山东公安厅机密文件,针对“三组织”成员,指示可以先抓捕、羁押,再补办手续和审讯。这份“01号密令”还说,对潜到境外的“三组织”主要参与者,要控制他们的亲属电话、电邮等,而亲属有所谓隐瞒、谎报等,可处行政拘留。
广州维权律师唐荆陵认为,这个密令实际上是“未审先定罪”,是不合法的。
广州维权律师唐荆陵:“当有一些觉醒的人可能看到这样的文件,意识到这样的文件它的非法性;再一个,像这种非法的命令,逼迫他们犯罪的这样一些文件,他如果不公开的话,那么他可能面临更大的压力。把这些文件公开了之后,当局的很多罪行就很难再展开了,这样从客观上能保护体制内一些有良心的人士,会少一些被迫从事这些犯罪行为的机会。”
密令中还指示用金钱诱惑基层群众参与迫害。允诺给参与迫害的专案组公安双倍岗位津贴,而经费由省公安厅全包支付。
密令还附有黑名单,并印发给各地公安局。行动日期从今年(2013年)1月4号至2018年12月31号。
山东省公安厅的这份密令,和中共总书记习近平最近的公开指示互相矛盾。
习近平在1月7号的全国政法工作电视电话会议上说:“全国政法机关要顺应人民群众对公共安全、司法公正、权益保障的新期待”,并要求政法系统以“平安中国、法治中国、过硬队伍”为目标。
在此之前,习近平也在纪念中国《宪法》实施三十周年的纪念会上表示,《宪法》的生命在于实施,宪法的权威也在于实施。他还强调:保证宪法实施,就是保证人民根本利益的实现。任何组织或者个人,都不得有超越《宪法》和法律的特权;而一切违反宪法和法律的行为,都必须予以追究。
河南《东方今报》报导指出,一些地方政法委在案件还未审理时,就召开司法机关协调会,为个案下定论,不仅影响司法公正而且违法,却屡见不鲜。而要想审判机关、和检察机关依法独立公正行使审判权和检察权,就要进一步明确政法委的职能定位。
独立评论员邢天行:“政法委迫害法轮功开始,真正把中国司法体制已经彻底的给颠覆掉了。从司法机关组成人员来看,他们已经不是遵守法律,他们已经在道德底线下不光是执行恶法,他们是中国社会整个败坏的一个根源。”
独立评论员邢天行认为,现在中共的政法委系统是惯性作恶。她说,在中国,要想遵照《宪法》并改变原来的恶法和坏政策,习近平必须与整个江泽民的江系交锋。邢天行认为,这是摆在习近平面前的一个难题。
邢天行:“原来就是中共最高层决定的政策下去(施行)的,对法轮功的打压,包括对所谓地下教会暗中的打压,这已经是既定的政策下发的,如果现在下边要想有一个大的变化,必须是从中共高层、从习近平开始有一个明确的、对以前政策等于是推翻。”
北京观察人士华颇指出,落实《宪法》,中共将失去对意识形态和舆论的控制;如果允许政治反对派的合法存在,中共当局对社会的控制也将形同虚设。所以,华颇认为,“宪法梦”注定“梦难圆”。

Implementing Chinese Constitution is only a Dream.
Shandong Province Convicts People before Trial.
“No.01 Confidential Notice in 2013” was issued by
Shangdong Public Security Office.
This says that members of underground cult group such as
Jasmine revolution organization and the illegally outlawed
spiritual group of Falun Gong Practitioners can be arrested
and detained prior to procedure, paperwork and trials.
These can follow up afterwards.
Their behavior severely violated constitutional law.
It is a stick warning to the public who still hope the Chinese
Communist Party (CCP) implements a justice law system.
An anonymous person disclosed this confidential document.
He said, “In order to prevent more people from being persecuted,
I follow my conscience in revealing this document.”
This document ordered police to arrest and detain first,
go through formalities afterwards.
This No.1 Confidential Notice also states for those active
participants of these three organizations overseas,
their phone calls, emails and letters should be monitored.
If their relatives concealed or made false reports,
they can be placed under administrative detention.
Guangzhou rights lawyer Tang Jingling believe that in reality,
this document convicts without trial, and it is illegal.
Tang Jingling: “Maybe when some enlightened people see this
document, they will realize its illegal nature.
Besides, if they do not disclose these illegal documents which
force them to commit crimes, they may face greater pressures.
After these documents are made public, the CCP will not be
able to commit a lot of the crimes they usually do.
This way it will protect those with consciences in the CCP
objectively, with fewer opportunities for their forced crimes.”
The Confidential Document also instructs the use of money
to tempt grassroots masses to participate in persecution.
By promising to double the salary of public security officers
participating in the persecution, expenses will be completely paid for by the provincial public security bureau.
A Black List is also included with the confidential document,
and distributed to public security bureaus in various regions.
Effective from January 4th 2013 to December 31st 2018.
This confidential document from Shandong Public
Security Office conflicts with CCP General Secretary Xi Jinping’s recent public instructions.
At the National Political and Legal Work Television and
Telephone Conference on January 7th Xi said:
“Law enforcement authorities should meet the people’s hopes of
public security, judicial justice and protection of rights nationally.”
He also ordered law enforcement authorities to set their goals to
bring peace to China, rule China with the law with a capable team.
At the 30th annual commemoration of the implement of
Chinese Constitution, Xi said its essence lies in implementation.
The power of Chinese Constitution also lies in implementation.
He emphasizes guaranteeing the implementation of the
Constitution is guaranteeing the peoples’ fundamental benefits.
No organizations or individuals should have the
right to surpass the Constitution whatsoever.
All behaviors not following the Constitution
must be investigated.
Henan Newspaper Jinbw points out some local Politics and
Law Committee members host judiciary coordination meetings.
They use these meetings to make conclusive decisions on
individual cases before trial.
Not only is this illegal, it also affects judiciary justice.
Yet these behaviors continue to carry on.
But for judicial and procurator bodies to independently and
righteously exercise their judicial and prosecution power,
it is necessary to take one step further to clarify the function
and position of the Politics and Law Committee is necessary.
Independent commentator Xing Tianxing: “Politics and Law
Committee completely overthrew China’s legal system since it started the persecution of Falun Gong.

Xing believes now the Politics and Law Committee
commits evil acts habitually.
She said to follow the Chinese Constitution and to change bad
policies in China, Xi Jinping must face Jiang Zemin and faction.
Xing believes this is a difficult problem Xi has to face.
Xing Tianxing: “The order to persecute Falun Gong
originally came from the highest level in the CCP.
This included the persecution of underground churches
carried out in the dark. This is an established policy.
If a huge change is come, it must come from
high level CCP, from Xi Jinping giving a clear statement to overthrow the previous policy.”
Hua Po, an observer from Beijing says implementing the
Chinese Constitutions means the CCP will lose its control.
Public opinions and ideologies will no longer be controlled.
If political opposition groups are allowed to exist legally,
the CCP’s control of Chinese society will also cease to exist.
Hence, implementing the Chinese Constitution
is only a dream.
