【新唐人2012年11月30日讯】大陆首宗“起诉截访人员非法拘禁访民”的案件,28号在北京一审第三次开庭后作出宣判,10名涉案人员全部罪成,主犯判刑1年半。但受害访民不满判决,认为幕后指使者仍逍遥法外。接下来请跟本台记者一起去了解。
北京当局28号对一个非法“截访”团伙作出宣判:主犯判刑1年半,其余9名涉案人员各判刑数个月。
今年5月初,来自河南的桑淑玲等12名访民,在北京被截访后送往“久敬庄”关押,后来数名挂着“河南驻京办”胸牌的截访人员,将他们带走并关押到另一所“黑监狱”。过程中,访民受到截访人员的殴打和多次恐吓。后来北京警方出动警察,释放了全部访民,并且将10多名截访者抓捕。
但是,日前,案件审理期间,出庭作证的受害访民桑淑玲多次要求法院依法判决,追究幕后指使和策划绑架的人员责任。而法官不但没有接纳,反而多次试图说服受害访民接受赔偿方案。
上海访民蔡文君:“维权人士抓进去以后,判了输赢。赢了,这个案例,他们不追究他们的责任,做官的做坏事做多了不但不是降级都升级的。这个体制不改老百姓没什么好路好走。”
另一名受害访民丁新芳也不满判决,认为他们是在搞应付。
不过,《六四天网》曾揭露,当初是由于河南长葛市政府截访人员只带了12万元去带人,北京截访单位拒绝将已被截访的访民,全部移交给河南当局,北京截访单位只移交了3名访民给河南当局,所以,才有所谓北京出动警察救出10多名河南访民的机会。
蔡文君:“每个访民身上的维稳费还很多哩,把你们解决了,他们到哪里去贪污啊?这个维稳费里面他们还要贪呢。北京不是有的警察就说了,把你们解决了,我们吃什么﹖﹗”
上海访民蔡文君还表示,地方政府根本不去解决维权人士反映的问题,他们只好到北京讨说法。但是,当官的为了政绩,就把维权人士关进黑监狱、劳教、判刑等。她说,以后当局甚至会用“ 矫治所”来代替 “劳教”。

上海维权人士冯正虎,从今年2月27号到这个月(11月)20号,已经被软禁了268天,不能出门,看病都必须在当局人员陪伴下求诊,朋友也无法上门探访﹔北京维权人士许志永遭拘禁30多小时,只因当局为了防止他去“聚餐”﹔湖北维权人士秦永敏十八大之前就已经失踪,到现在没有音讯﹔浙江民主人士陈树庆和吕耿松最近也先后被国保传唤。
中国天网人权事务中心负责人黄琦对《自由亚洲电台》表示,北京当局判决截访人员,无疑会起到一定的阻吓作用。
权利运动组织负责人胡军表示,在此之前,建“黑监狱”的“北京安元鼎保安公司”在2010年被打掉,人们曾经幻想访民的待遇会得到改善,但实际上截访比以前更严厉。
权利运动负责人胡军:“如果没有还权于民的过程的话,其他做的任何事情都是假的,都是在演戏,都是在搞欺骗。不管经济体制改革也好,还是政治体制改革也好,衡量它一个标准,是不是让老百姓说话,是否还权于民这个过程要走。不走,那等于空的。”
胡军认为,中国老百姓连基本的表达权都没有,一切还是以公权力说了算,当局所做的,都是为了维护中共这个独裁体制。
中国民主教育基金会会长林牧晨指出,“十八大”给人一个最大的启发就是,与其期待中共政治改革,不如组织起来推动中国的变革。

Reality Behind Sentencing of Petitioner-Interceptors in China
A Beijing court delivered a verdict on China’s first case of
Interception and detaining petitioners on November 28.
The ten culprits were sentenced to jail, with the longest
prison term of 1.5 years.
However, the petitioners are dissatisfied with the judgment.
They said that the plotter behind the scenes is still at large.
On Nov. 28, an illegal gang tasked with intercepting
petitioners was pronounced guilty in a Beijing court.
The principal culprit was sentenced to 1.5 years in jail,
the remaining nine being sentenced to several months.
Early in May, 12 petitioners from Henan Province
were intercepted while petitioning in Beijing.
They were detained in Jiu Jing Zhuang,
a notorious “black jail" used by the authorities.
Later, a few petitioner-interceptors from “Henan Liaison
Office in Beijing” transferred them to another “black jail".
On the way, they repeatedly assaulted and threatened
the 12 petitioners.
Afterwards, Beijing police released all the detained petitioners
and arrested over a dozen of petitioner- interceptors.
Sang Shuling, one of the 12 petitioners, has repeatedly
requested of the court to find out the off-stage suspect.
The judge denied her request, the same judge also made
many attempts to persuade the victims to accept a compensation scheme.
Cai Wenjun(Shanghai petitioner): “The rights activists were
illegally detained by local authorities.
Although the petitioners won the case, the real culprit
behind the interception hasn’t yet been held accountable.
The officials all got promoted instead of downgraded for
doing evil things.
We ordinary people have no hope if this system of the
Chinese Communist Party (CCP) still remains the same."
Another victim petitioner Ding Xinfang was also dissatisfied
With the court’s decision. Ding said that the authorities just “went through the motions”.
64tianwang.com disclosed more stories behind this
interception. The CCP authorities of Changge, Henan, sent petitioner-interceptors to Beijing.
They carried 120,000 RMB in an attempt to take back the
12 petitioners.
However, their Beijing peers only handed over
three petitioners to them.
That created a chance for Beijing police to
rescue other Henan petitioners.
Cai Wenjun: “Funds allocation for stability preservation
is big for capturing one petitioner.
If all petitioners’grievances get redressed,
how would they make money then ?
The outlay for stability preservation is just a way
for them to pocket money.
The Beijing police spoke to us, “where’s our income
going to come from if all your problems get solved?!”
Cai Wenjun adds that local CCP authorities have never
solved problems reported by rights activists.
This forces petitioners to go to Beijing to seek solutions.
Yet, CCP officials, to secure their political achievements,
sent them to “black jails”,
re-education-through-labor and regular jails.
Cai Wenjun reveals that in the future,
the CCP authorities will replace “re-education through labor” with “correctional institutions”.
All the time, the CCP regime has never relaxed it’s
control over dissidents.
Feng Zhenghu, rights activist in Shanghai, has been placed
under house arrest for 268 days since this February.
Feng was banned from going out and being visited by friends.
He had to be accompanied by local police even
when going to see a doctor.
Beijing’s rights activist Xu Zhiyong has been detained
for over 30 hours, simply to be blocked from going to “dine with others”.
Qing Yongmin, rights activist in Hubei, has been
missing since before the 18th Party Congress until now.
Chen Shuqing and Lü Gengsong, pro-democracy activists
in Zhejiang, have been summoned by local security police.
Radio Free Asia reported that Huang Qi, chief of China
Tianwang Human Rights Center, believes that
Beijing’s conviction of petitioner-interceptors will
deter interception, to some extent.
However, Hu Jun, head of a Human Rights Campaign
in China, reveals the current situation.
A Beijing-based security company that had set up and
run “black jails” for the authorities, was shut down in 2010.
However, official interceptions from regions across China
became tighter than before 2010.
Hu Jun: “Without returning power to people, official claims
are all empty talk ,and just a show to fool the public.
A test to measure the alleged reforms, in economy or
in politics, is whether civilians have freedom of speech.
And whether they go through a process of returning
power to the people. Otherwise, the touting of reforms means nothing.”
Hu Jun says that if Chinese civilians still lack basic rights to
expression, and the CCP has the final say on everything,
that means that all the authorities have done is to
maintain CCP dictatorship rule.

Education Foundation, comments.
The biggest revelation from the 18th Party Congress
is that it would be better for the public to
push forward change in China than to expect anything
to come of the CCP’s alleged political reforms.
