【新唐人2011年11月26日讯】中国最神秘的机构是“有关部门”,而中国最神秘的行业则是“临时工”,他们无所不在却又不存在。在中国,合法权益不能保障,临时工成了替罪羊,中共的《劳动法》实施十几年,单位利用“临时工”之名,侵犯劳动者权益的问题却依然存在。
最近,从城管执法打人、江西修水县女警发飙拿资料砸群众、残疾人住房被强拆、“中华脊梁奖”伪造文书,到政府公务人员酒后驾驶等等,每个案件的肇事者几乎都跟“临时工”有关。
大队长吴忠强承认,打人的几个人确实是特警队的,但不是民警,咱单位的临时工,在这临时工作的。
中共《侵权责任法》第三十四条规定,“用人单位的工作人员因执行工作任务造成他人损害的,由用人单位承担侵权责任。”
北京市博圣律师事务所律师韩一村:“根据法律规定,有些职责他是不能授予临时工去执法的,当然有些特定的情况,如果警察聘那些临时工,那是违法的。”
对此,网络政论作家杜导斌表示,有些单位为了掩护编制外的临时工,他们会用各种方法向社会捞钱来开支这些工资,警察聘用临时工,在中国是非常普遍的现象,也没看过因此受罚的。

政论作家杜导斌:“他们不是警察,然而又执行警察的权力,这种现像在国内是非常常见的,不仅仅是警察部门、城管部,还有很多部门都存在这种现象。”
网友“剑气如虹”说,这已经成了一道公式,就是有多少野蛮执法,就有多少“临时聘用人员”,有多少媒体曝光,就有多少“临时聘用人员”被处理。
中国“临时工”蓬勃发展的真相到底是什么?有媒体分析,聘用临时工有四大理由,第一,顶替相关责任,弃车保帅,相关部门处理热点、焦点事件风险较大,需要“临时工”冲锋陷阵。而一旦出现偏差、发生问题,自有“临时工”顶缸。
第二,有利于编织和结牢关系网,如果对聘用人员稍作了解,就会发现这些人员多与这个部门或关联部门的头头脑脑或实权人物有着千丝万缕的亲朋关系,构筑了一道错综复杂的关系网。
第三,可保广开财源,“钱途”亨通,无论是财大气粗还是经费不足的执法部门,都可以执法为名让临时工进行乱收费、乱罚款来充实单位的“小金库”,然后再供给领导者自由支配。
第四,出事后容易辞退,“临时工”相比“正式工”更好处理,包括随时辞退。“正式工”野蛮执法虽然可以处理,但是由于有编制,所以一般情况之下难以辞退。
政论作家杜导斌:“中共本身就是乱套,是不明确的,部门职责划分就不明确,然后有相当一部分,就业很难,上面把城管、警察机关所谓的编制都给掐死,然后下面呢,需要的时候就请临时的。”
“临时工”和神秘的“有关部门”,两者有异曲同工之妙,当中国社会出现问题需要追究责任时,他们会同时出现扮演“背黑锅”的角色。
有网友说,自从央视大楼在正月十五被“临时工”点了蜡烛以后,“临时工”这个群体就在中国的“背黑锅”事业中一片欣欣向荣,只要“有关部门”出了什么丑闻,一定都是“临时工”干的!

Some media have found that there are four reasons for hiring
temporary workers.
Firstly, to replace responsibility, they need
“temporary workers” to take risks because the relevant
departments face a burden of bigger risk in

Secondly, temporary labor helps build and solidify the network.

It is easier to fire “temporary workers" than “official workers"
and “ temporary workers “ can be dismissed at any time.
