【新唐人2014年01月24日訊】隨著「新公民運動」系列案件的陸續開審,大陸媒體連日來大肆報導企業家王功權已經「認罪」,以及他會與「新公民運動」發起人許志永所謂「決裂」的消息,但外界普遍質疑王功權是在酷刑虐待和高壓下,被逼迫「悔過」與「認罪」。與王功權相反的是,許志永因為拒不認「罪」,並在法庭上沉默抗議,有可能被判5年的監禁。
1月22號,北京第一中級人民法院在官方微博上說:「王功權承認與許志永一起策劃、煽動了聚眾擾亂公共場所秩序的違法犯罪活動,他對自己的行為表示深刻反省。北京市第一中級人民法院依法對王功權變更強制措施,予以取保候審。」
此外,《北京電視臺》也報導,王功權非常後悔資助許志永,和幫助傳播「新公民運動」的行為,以後他會斷絕與許志永的來往等。
官方的消息迅速被大陸各大媒體轉載報導,卻受到了輿論的廣泛質疑。
旅居紐約的中國互聯網觀察人士北風:「我甚麼時候都不相信官方單方面提供的信息。」
美國「公民力量」組織副主席韓連潮:「因為中共這個法制它本身不是公開的、不是透明的,沒有一個正當的法律程序。所以王功權到底是不是認罪,我覺得很難說,我認為它們基本上會採用這些逼供信的辦法,迫使他認罪,但是,現在到底是甚麼情況,我覺得不是很清楚,我是不相信他是真正的認罪,因為他所做的事情,都是正當的事情,也是很溫和、很公正的,沒有甚麼違法的行為在裡邊。」
在上海「華東政法大學」任教的張雪忠在微博上說:「我認真看過功權的供詞,確有些悔罪認錯的表述,但他並未出賣或陷害任何人;大家不要被當局的宣傳所誤導,讓我們敬佩和支持那些堅持的人;理解和寬待那些妥協的人。」
廣州文化人士葉恭默也公開指出:「即使在言說上最徹底強硬的人,都極少有人能扛得住趨近生理極限的精神和肉體折磨。再強大的個體,在暴力機器面前都是弱者。功權初進監獄難熬拷掠,認罪取保,完全可以理解。」
王功權的好友、媒體人笑蜀曾在香港《亞洲週刊》上透露,據王功權主辯律師陳有西了解,王功權在獄中70多天被提審多達92 次。11 月初更是每天提審三到四次。等於變相的刑訊逼供,給王功權造成巨大的精神痛苦,精神瀕於崩潰,最終寫了長篇供述。
在官方發佈王功權「認罪」消息的同一天,許志永的庭審也在北京開審。
韓連潮:「他和他的律師都是保持沉默,因為他們覺得審判不公正,即使是中共規定的法律,它們也沒有按照程序去執行,所以他們只有通過沉默來對法庭不公正來進行抗議。」
據《法國國際廣播電臺》報導,許志永的辯護律師張慶方強調,當局提出的控罪是無中生有,毫無依據,但控方在庭上要求「從重處罰許志永」,一旦罪名成立,許志永將面臨最高5年的監禁。
對於同一天,一方面北京中級法院宣佈「認罪」的王功權可以取保候審,一方面對許志永的沉默抗議表示要「重判」,不少人認為,當局截然不同的處理方式別有用心。
北風:「毫無疑問它有離間企業界和異議群體目地所在,另一方面,也會打消民眾對後續的新公民系列案件的興趣。」
韓連潮:「中共歷來的做法都是各個擊破,重點打擊,然後找到一些薄弱環節。我想這次也不會例外,它一定是通過逼供信、通過各種各樣辦法,迫使王功權就範,有可能讓他假釋,通過提供的一些口供,再反過來嚴懲許志永。」
美國人權組織「公民力量」副主席韓連潮指出,如果當局真的嚴判許志永,一定會激起公民義憤,加劇官民對立,促使中國社會矛盾進一步激化,但「新公民運動」卻永遠不會因為當局的打壓而停止。

Torture and Forced Confessions of“New Citizens Movement”Members?
Along with trials of the“New Citizens Movement" members,
Chinese media recently reported widely that,
entrepreneur Wang Gongquan has pleaded “guilty" and he would
separate from the “New Citizens Movement" founder Xu Zhiyong.
It is believed the Wang Gongquan was forced to “repent"
under brutal torture and intense pressure.
On the other hand, Xu Zhiyong refuses to admit to any “crime.”
He made a silent protest in court and
now he may be sentenced to five years in prison.
On January 22, Beijing First Intermediate People’s Court
stated on its official micro-blog:"Wang Gongquan admitted working with Xu Zhiyong
to plan and incite crimes that disturb public order.He expressed deep remorse for his actions.Beijing First Intermediate People’s Court will change the
severe measures on Wang Gongquan and allow him out on bail.”
In addition, Beijing TV also reported that,
Wang Gongquan seriously regretted that he funded Xu Zhiyong
and help promote the “New Citizens Movement.”
He would cut off connections with Xu Zhiyong in the future.
This official news was quickly reported by Chinese media.
But it is widely regarded with skepticism by the public.
Chinese Internet Watcher in New York Bei Feng:"I never believe the news provided by the officials unilaterally."
U.S.“Citizen Power"organization Vice Chariman Han Lianchao:"The Chinese Communist Party (CCP)’s legal systemis not transparent, nor is there a normal legal process.
It is hard to say if Wang Gongquan admitted his crime.I think they basically used all means to force him to confess.But in the end what is the situation, I am not very clear.
I do not believe he really confessed,
because what he did is right, gentle, fair and nothing illegal."

Zhang Xuezhong wrote on his microblog:
I carefully read the Wang Gongquan’ confession statement.
It indeed expressed repentance, but did not fool or delude anyone.
Please do not be misled by the authorities’ propaganda.
Let us admire and support those who insist on their belief
and understand those who gave in and compromise.
Guangzhou art and culture professional Ye Mogong stated:
Few of the toughest writers could endure mental and physical torture.
Powerful individuals are weak facing torture machines.
Gongquan confessed and got out on bail facing brutal tortures.
It is completely understandable.
Wang Gongquan’s friends and the media professional
Xiao Shu revealed to HK’s Asia Week, that:
according to Wang Gongquan’s lawyer Chen Youxi,
he was interrogated 92 times during his detention over 70 days.
In early November he was questioned three to four times a day.
This is another kind of torture. It caused great mental anguish.
Wang was at the brink of collapse
and eventually wrote the lengthy confession.
On the day when the officials released Wang’s confession,
Xu Zhiyong’s trial began in Beijing.
Han Lianchao: “Both him and his lawyers remain silent,
because they feel it was an unfair trial.
Even CCP’s law is not followed.
They had no choice but to protest with silence against the injustice."
According to Radio France Internationale,
Xu Zhiyong’s defense lawyer Zhang Qingfang stressed that
the authorities’charges have no basis.
The prosecution asked the court to “severely punished Xu Zhiyong."
If convicted, Xu would face up to five years in prison.
Beijing Intermediate People’s Court announced
that Wang Gongquan would be let out on bail
and expressed on the same day, its intention to heavily
sentence Xu Zhiyong.
Many people think the authorities have ulterior motives.
Bei Feng:"There is no doubt it wants to break the connection
between the business community and dissident groups.
It also dispels citizens’interest in the subsequent
cases in the series."
Han Lianchao:"The CCP always breaks up people’s connections,
focus on key opponents and find weaknesses.
I think this time there is no exception.
It must have forced Wang Gongquan to give up
through a variety of ways,
and use what Wang confessed to punish Xu Zhiyong."
Han Lianchao pointed out that a severe sentence for Xu Zhiyong
will arouse people’s anger, worsen the opposition between
officials and the public and further stimulate social conflict.
But the “New Citizens’ Movement" will not stop
because of the suppression.
