【新唐人2014年01月25日訊】1月22號,北京在審判「新公民運動」發起人許志永案的同一天,宣佈大陸投資人王功權認罪,並給予取保候審。王功權的朋友在接受本臺記者採訪的時候,肯定並理解王功權,而對中共當局的分化瓦解策略表示鄙視。知情人士透露,當局擔憂﹕抓捕王功權令企業家感到心寒,而加速移民潮。
北京市第一中級人民法院週三晚間在官方微博上說,王功權承認與許志永一起策劃、煽動聚眾擾亂公共場所秩序的違法犯罪活動,對自己的行為表示深刻反省。將對王功權予以取保候審。
大陸律師張慶方向《新唐人》透露,法院之所以批准王功權取保候審,有兩個原因。一個是,王功權基本上沒有參與起訴書指控的五次所謂「擾亂公共秩序的行為」。另外一個則是,很多企業界的企業家們也在不停呼籲,釋放王功權、不要迫害企業家。當局也必須考慮企業家的態度。
北京漢鼎聯合律師事務所合夥人張慶方:「因為一旦給王功權強行定罪,就有可能讓更多企業家認為,在中國是不安全的。就會推動現在的移民潮。這會對中國的經濟不利。這也是政府必須考慮的因素。」
張慶方是「新公民運動」許志永案的辯護律師,他看過王功權的審訊筆錄和認罪書。
張慶方:「因為他並沒有把責任往別人身上推,或者說他為了使自己能盡早的獲得自由,去歪曲甚麼、去迎合甚麼,是沒有的。其中涉及到我的一些問題,我看到王功權還都是把責任往自己身上攬,我看了也是非常感動。」
張慶方認為,王功權在裡邊沒有出賣任何人,也沒有歪曲任何事實。他是為了盡早獲得自由,陪伴家人,才向當局妥協,他的朋友們完全可以理解,他並沒有因此喪失尊嚴。張慶方認為,喪失尊嚴的應該是強行逼迫人認罪的司法。
王功權的朋友,北京人權活動人士胡佳表示,在王功權出獄當天,他立刻給王功權發了一封微信問候,並讓他好好休養。胡佳表示,共產黨說的任何話,包括北京中院發佈的消息,都不足為信。
北京人權活動人士胡佳:「在那種環境下,密集提訊,城下之盟。因為共產黨特別善於在法律之外的事情上來對你做要挾威逼。你像原來高智晟律師就是,你在這裡撐著,那麼你的妻子女兒和兒子就要在那邊受苦。就明確的給他這樣。」
王功權能夠在新年前夕回家,和家人團聚,胡佳表示為他高興。而所謂的悔過書,只能用以證明﹕當局手段的齷齪和卑鄙。
胡佳:「他沒做錯甚麼事情。包括他現在所謂的悔罪,在電視上這些東西,都沒所謂。因為你面臨著一個不對稱的對手。不是每個人都要去做英雄的。而且他現在並沒有……他也並非不是英雄。他以前做的那些事情,包括他倡導教育平權,而且他也出現過在黑監獄的門口。」
有分析說,法院在審判許志永的同一天宣佈王功權認罪、並取保候審,是挑撥離間企業家和人權活動人士的關係。胡佳表示,看到一個成功的投資人被抓了,企業家們肯定有害怕的,但是同時,也會對這個體制感到強烈的不安全感。
胡佳:「會有反感,他也有憤怒。儘管有些人是敢怒不敢言。那麼憤怒是甚麼東西?害怕又是甚麼東西?你害怕一個人,你肯定是憎恨這個人的,就是在積聚這個怒火。企業家階層,本身南方就有一些中小企業家,在很低調、很隱秘的情況下,資助街頭舉牌的行動者。」
胡佳表示,現在許多企業家明白,在中共體制下,人民的財產和人身權利都得不到安全,只有徹底改變一黨專制體制。因此他肯定還會有企業家站出來,資助「新公民運動」,和其他公民自發的街頭行動。

Afraid of Pushing More Business Owners Out Of China,
the CCP Authority Releases Wang Gongquan
On Jan. 22, Xu Zhiyong, founder of New Citizens’ Movement,
was tried by the Chinese Communist Party’s (CCP) authority.
On the same day, Beijing announced that investor
Wang Gongquan, an advocate involved in the movement,
was released on bail because he confessed to his crimes.
A friend of Wang’s told NTD that he could understand
Wang’s decision and it’s the CCP’s demoralization strategy
that should be despised.
Sources revealed that the party feared the arrest of Wang
might further push Chinese business people to emigrate.
Late on Wednesday (Jan. 22), Beijing No. 1 Intermediate
Court announced on its Weibo page that Wang Gongquan
had admitted to collaborating with Xu Zhiyong on charges
of plotting illegal activities that “disturbed public order".
The court said Wang would be released on bail,
as he promised to reflect upon his “crimes".
Chinese lawyer Zhang Qingfang told NTD that there are
two reasons the court approved the release of Wang.
First, Wang did not participate in any of the five events
which were claimed to have “disrupted public order"
by the authority.
Second, many Chinese business people have continued
to advocate for the release of Wang and call for an end
to the persecution of entrepreneurs;
The CCP was forced to consider their attitude
in such a situation.
Zhang Qingfang(Chinese lawyer): “If Wang is unjustly
convicted, more entrepreneurs will regard China
as an unsafe place.
This will further push the current emigration wave
and bring harm to China’s economy.
Therefore the CCP authority has to take this effect
into account."
Xu Zhiyong’s defense attorney Zhang Qingfang read
Wang’s trial record and his confession statement.
Zhang Qingfang:"He (Wang Gongquan) did not attempt to
push the blame on others,
distort the truth or curry favor for his freedom.
I am also involved in some issues.
But I saw that Wang attempted to take all responsibilities
on by himself. I was truly moved by that."
Zhang Qingfang said Wang did not betray anyone
or distort any truth during arrest.
He simply compromised with the party because he
wanted to meet with his family as soon as possible.
His friends can fully understand him and he has kept
his own dignity.
Zhang said the one that lost dignity was the party’s judicial
system as they forced people to confess to baseless charges.
Wang Gongquan’s friend, the famous Beijing human rights
activist Hu Jia, said he had sent a WeChat message to Wang
immediately after his release, wishing him a good rest.
Hu Jia said none of the CCP’s words can be trusted, including
the announcement of the Beijing Intermediate Court.
Hu Jia, Beijing human rights activist: “They forced
a compromise with intensive interrogation
in an enclosed environment.
The party is especially good at intimidating people
with extrajudicial measures.
For example, in Gao Zhisheng’s case, he was clearly
informed that his wife and children would be tortured
if he refused to confess.
They just do things like that."
Hu Jia is happy that Wang Gongquan can go
back home right before the Chinese New Year.
On the other hand, the so-called “statement of confession"
only shows how unscrupulous the party is.
Hu Jia: “He didn’t do anything wrong, including his so-called
‘confession’ that was broadcast on TV.
The fact is that he was facing an overwhelming opponent.
Not everyone has to be a hero.
Besides Wang is still a hero for his previous actions,
such as advocating equal educational opportunities
and visiting black jails."
There are comments saying that the party tried to create
dissent among business people and rights activists
by releasing Wang on bail right after
announcing his “confession".
Hu Jia said entrepreneurs were definitely frightened
when they saw the arrest of a successful investor.
However, this also induced a strong sense of danger
against the regime among those elites.
Hu Jia: “This will lead to antipathy and anger, although
many people won’t directly speak out about their feelings.
What is anger? What is fear?
When you fear someone, you also have hatred
against that person.
So the feelings of anger accumulate.
In south China, many small to mid-size business owners
are financially supporting street protesters in a low-profile
and secretive manner."
Hu Jia believes many Chinese business people now
understand that there is no protection of private assets
and personal safety under the CCP’s governance.
The only solution is to completely overturn
the CCP’s one-party dictatorship.
Hu therefore concluded that more business owners will
stand out to support the New Citizens’ Movement
and other spontaneous civil rights activities.
