【新唐人2012年9月25日訊】24號上午9點過後,中共喉舌《新華網》以英文稿,刊登對重慶市前公安局局長王立軍案的判決。宣判結果引發外界一片譁然,都認為法官「輕判」王立軍。有律師指出,法庭審判谷開來案和王案之間存在極大矛盾。另有評論認為,直接指向「薄王谷」三人的活摘法輪功學員器官罪行,不會在王、谷案,甚至處理薄熙來時,體現出來,因為那等於是對共產黨整體的清算。
成都高級法院宣判王立軍一審判決結果:數罪併罰有期徒刑15年。《新華網》隨後報導宣判結果及案件局部細節。報導最後指稱,王立軍當庭表示不上訴。
原北京律師李莊24號向《新唐人》表示,成都高院對王的判決,毫無疑問判得太輕。除此之外,還有嚴肅的適用法律問題。李莊指出,審判谷開來時,法庭展示的證據顯示,谷、王是殺害英國商人海伍德的同謀,而出謀策劃的是王立軍。
北京律師李莊:「在成都的審判上就成了立功了,所以說很滑稽﹔第二,受賄三百零五萬怎麼能判九年呢?按現行有效的法律來講,受賄十萬『起刑點』就得是十年﹔低於法定最低刑以下還要低,這就讓很多民眾不可理解、不可理喻。」
而前「哥倫比亞大學」訪問學者、政論作家陳破空則分析,比照谷開來和重慶4名高級警官案可判斷,王的罪刑會高於4名警官,但低於谷開來,因此,判王立軍15年刑期完全在預料之中。
另外,依成都庭審記錄顯示,仍然沒有提到王的頂頭上司薄熙來。陳破空認為,對於王立軍所謂立功表現—-有關薄熙來案件的伏筆,目前,中共高層仍猶豫不決或還沒有達成一致。
政論作家陳破空:「我們看薄熙來案,和陳希同和陳良宇案有一個很大的不同就是,它沒有一貫到底;而是,中途由高調轉為低調,由明朗轉為不明朗。我想習近平、賀國強和溫家寶是堅定倒薄以外,應該是胡錦濤他可能是想跟強硬派做一個交換,就是自己想留任軍委主席2年,因此作出讓步。」
中共十八大在一個月之內即將召開。陳破空認為,在召開十八大之前,中共當局可能撤銷薄熙來在黨內的政治局委員和中央委員職務,或者開除他的黨籍。
陳破空:「還是給毛左派、挺薄派一個面子,不想在18大之前,把這一層紙捅穿,進而影響到18大中共內部的所謂穩定。所以,根據王立軍案和目前的中共政局來看,18大之後法辦薄熙來的可能更大一些。但是,對習近平執政就留下了一個定時炸彈,非常不利。」
陳破空分析,原先中共即將上任的接班人習近平,希望未來的政途平順,想藉助倒薄派的力量,在18大之前處理掉薄熙來。
陳破空:「但是中央高層很多人自己打自己的算盤,各懷鬼胎。挺薄派要保全他們的利益,要填補薄熙來被打倒之後留下的權力真空。而倒薄派裡,也出現了一些分歧。所以,我覺得要解決薄熙來的問題,還是要18大之後,寄望在習近平身上。」
而針對「大連塑化人體工廠」和「活摘法輪功器官」的罪行,當局在王和谷案中,都沒有提出偵察。陳破空認為,在審理「薄熙來案」時也不會涉及相關的偵察。
陳破空:「因為,這是一個整個政權的犯罪,這是一個全國各地,包括610辦公室,包括江澤民這個體系,周永康政法系統全部在內的一個普遍的罪行,也就是說,共產黨本身的一個罪惡。所以,這個罪行要辦的話,就意味著對共產黨整體的清算。」
陳破空指出,王立軍只是胡溫高層用來收拾薄熙來的一顆棋子。對王的判決,就是兩派達成妥協後的最後結果。

Wang Lijun Given Lenient Penalty
On September 24, Xinhua News Agency, mouthpiece
of the Chinese Communist Party (CCP), released news in English about the court verdict on the Wang Lijun case.
The legal decision triggered public uproar, as Wang
was deemed to have been given “lenient" penalty.
A lawyer pointed out an obvious contradiction
between the trials of Gu Kailai and of Wang Lijun.
Analysts believe that the crimes of live organ harvesting,
which heavily involved Bo Xilai, Wang Lijun and Gu Kailai,
will continue to be covered up even, in the trial of Bo Xilai.
According to commentators, this is because bringing these
crimes to justice equals bringing the CCP itself to justice.
The Chengdu High Court sentenced
Wang Lijun to 15-years in jail.
Xinhua News Agency subsequently reported
details about Wang’s case, and the verdict.
Wang Lijun reportedly declined to appeal.
Li Zhuang, former Beijing-based lawyer, thinks that
Wang Lijun was given an over-lenient sentence.
The court decision should have seriously applied a law.
Li Zhuang says that during the trial of Gu Kailai,
evidence showed that Wang not only worked on the idea,
but also helped Gu murder British businessman
Neil Heywood.
Li Zhuang: “But in Wang’s trial, it turned out that
Wang had made contributions in the investigation.
What an absurd claim!
Secondly, how was he sentenced to only nine years
for taking bribes of 3.05 Million yuan?
According to Chinese law, bribery of 100,000 yuan
would be given a minimum of a 10 years jail term.
So now his nine-year sentence for bribery
is even shorter than the minimum penalty.
This has obviously puzzled the public.”
Critic Chen Pokong says that compared to the verdict
for Gu Kailai and four senior police officers in Chongqing,
Wang Lijun had been expected to be given a heavier
penalty heavier than the four police officers.
However, it was predicted to be
a less severe sentence compared to Gu.
So Chen comments that Wang’s 15-year
jail sentence is completely expected.
The court transcripts showed that Wang Lijun’s
boss Bo Xilai, was not mentioned in the trial.
Chen Pokong says that the alleged contribution that Wang
had made actually alluded to the Bo Xilai case.
However, the CCP top leadership is still hesitant,
or not in agreement in how to deal with Bo Xilai.
Chen Pokong: “We’ve noticed the biggest difference
of the CCP’s handling of Bo Xilai,
in comparison with Chen Xitong and Chen Liangyu is that
the authorities didn’t carry through the investigation to completion.
Rather, halfway through, it turned from
a high-profile investigation into a low-key action, and from being focused to being vague.
I think that Xi Jinping, He Guoqiang and Wen Jiaobao
have all firmly showed a desire to punish Bo Xilai.
It is Hu Jintao who might have made
a deal with the hard-line faction.
With this, Hu may remain as Chairman of the Central
Military Commission for an extra two years.”
The CCP 18th Congress is scheduled to be held in October.
Chen Pokong speculates that before it convenes, Bo Xilai
may be expelled from the party’s Central Committee and its Politburo, or have his Party membership removed.
Chen Pokong: “This still has given a face
to the Mao leftists and the pro-Bo faction.
They don’t want to make it public before the 18th Congress,
which could otherwise impact the internal stability of the CCP.
From the Wang Lilun trial and current political situation,
it’s more likely to deal with Bo Xilai after the 18th congress.
But this amounts to leaving a time bomb for Xi Jinping,
which is a very unfavorable factor for him."
Chen Pokong analyzed that Xi Jinping had wanted
to rely on the anti-Bo force to purge Bo before he takes leadership at the 18th Party Congress.
Chen Pokong: “The CCP top leaders
are calculating for their own gain.
The pro-Bo force intends to fill in the vacancy
of deposed Bo Xilai, to preserve their interests.
Differences have emerged in the anti-Bo faction.
So I think Bo Xilai won’t be dealt with until after
the 18th Party Congress, by the hand of Xi Jinping."
During the Wang Lijun or Gu Kailai trials, the court
did not mention any investigation into crimes relating
to the Dalian corpse processing plant, nor into organ
harvesting from living Falun Gong practitioners.
Chen Pokong believes that even in the trial of Bo Xilai,
the CCP regime will not conduct these investigations.
Chen Pokong: “Because this is a crime done by
an entire regime of the CCP.
The crime has involved CCP officials nationwide including
members of Office 610, the force under Jiang Zemin
and the political and legal sector led by Zhou Yongkang.
In order words, this is a crime originated in the CCP itself.
So trying this crime amounts to bringing the CCP to justice.”
Chen Pokong thinks that dealing with Wang Lijun is an
intentional part of Hu & Wen’s strategy to punish Bo Xilai.
The verdict on Wang is actually the result
of a compromise reached between the two factions.
