【新唐人2012年6月30日讯】台湾新竹科技公司经理、法轮功学员钟鼎邦,被中共当局罗织“危害国家安全”等罪名,秘密逮捕的消息传出后,在世界引起了反响。美国资深国会议员认为,钟鼎邦目前身陷危险,呼吁国际社会应给予关注﹔钟鼎邦家人已经向总统府陈情,要求以政府层级委任当地律师在保障律师安全的同时,确保钟鼎邦人权不受侵害。与此同时,大陆法律界人士认为,当局的做法不具备合法性,应该无条件放人。
台湾法轮功学员钟鼎邦遭中共国安单位秘密逮捕后,钟鼎邦目前的安全问题已经引起了国际和海峡两岸各界的关注和担忧。
6月28号,美国资深国会议员、“台湾连线”创办人罗拉巴克以书面形式指出,中共攻击法轮功不仅只在中国,也扩展到全世界各地。事实上,中共使用非法的手段执政,却又借着看似“合法”的方式打压异己。
罗拉巴克认为,台湾法轮功学员钟鼎邦企图打破中共所垄断的信息而受到关押,依照过去的经验,他很可能面临酷刑,甚至有生命危险,他呼吁国际社会持续给予关注。
同一天,“国际特赦台湾分会”表示,英国总部已获知钟鼎邦案件,很快会发布全球紧急救援。
中共喉舌《新华网》指称,钟鼎邦是因为协助大陆居民进行“电视插播”,涉嫌从事所谓的“危害国家安全”行为,而被国安机构拘禁调查。
据了解,从1999年中共迫害法轮功开始,大陆多个地区出现了“电视插播法轮功真相”事件。影响力最大的当属2002年3月5号的“长春插播”,有数十万人在一夜之间了解了法轮功是一个什么样的信仰团体、了解了法轮功学员受到了怎样的迫害。这一次中共抓捕台湾法轮功学员钟鼎邦,许多评论认为,这是因为中共害怕法轮功真相大面积的传播。
北京律师唐吉田指出,在中国大陆这种特殊的情况下,不单单是信仰人群,就是其他人群想有效的获知真相也比较困难,而大陆现行的这种落后于国际和世界潮流的一些条文,与公民权利的实际需要的矛盾,始终存在。
唐吉田:“新华社也好,还是办案单位,向外界不断的去做出这种表态,或者是这种宣示,如果仅仅是因为信仰,无论是安监局,公安局也好,还是政法委,还是610,它们所作的这些所谓的侦查起诉,或者今后的审判执行,那都没有合法性。”
大陆维权律师李向阳表示,钟鼎邦帮助他的朋友或者一般的人,来接受任何电视广播信息,都是合法的。
大陆维权律师李向阳:“在中国大陆任何部门为了部门利益,或者为了维持中共的专制统治,他们都可以违背宪法,违背民意,制定一些条例、规章,强制中国的公民去执行。”
李向阳认为,钟鼎邦的做法是人道的,中共当局应该无条件释放钟鼎邦。而唐吉田律师也指出,国安机构拘禁钟鼎邦的理由——“危害国家安全”,这些法条的合理性与人权的标准有很大差距。
北京律师 唐吉田:“这个危害国家安全的…这笼统的这一些犯罪(认定),本身在中国大陆的立法上就有问题。有许许多多是公民正常权利,保障的内容,但是由于它和特权阶层是有矛盾的,所以也被它归为是所谓的危害国家安全。其实很多不是危害国家安全,而是在危害少数的维护特权,垄断一切的,危害了这样的一小部分人的利益。”
27号,钟鼎邦家人已经向总统府陈情,要求以政府层级委任当地律师,并保障律师安全,以确保钟鼎邦人权不受侵害,对此,陆委会表示关切。而台湾法务部部长曾勇夫以及法务部“国际及两岸法律司”都呼吁中共,处理钟鼎邦案的司法过程应该透明。

Opinion: Communist China Illegally Arrested Zhong Dingbang

Zhong Dingbang was arrested by Chinese authorities on charges of “endangering national security".
The news of his secret arrest caused a great reaction worldwide.
Seniors of U.S. House of Representatives believe that
Zhong is at risk and urged the international community´s
attention on this matter;
Zhong´s family petitioned the Office of the President for
the security of local lawyers with government level
appointment to ensure that Zhong´s human rights
are not infringed.
At the same time, mainland legal professionals believe
that the Chinese authorities did not have legitimacy and that
Zhong Dingbang should be released unconditionally.

Taiwan Falun Gong practitioner Zhong Dingbang was secretly
arrested by the state security in China.
Zhong’s current security issue has aroused the attention and
concern of the international community at all levels from across-the strait.
On June 28, the senior Democrat of the House of Representatives,
Mr Rohrabacher, along with the Taiwan Caucus founder both
pointed out in writing that the Chinese Communist
Party attacks Falun Gong not only in China,
but also extends this persecution to all over the world.
In fact, the CCP illegally seized power, but suppresses
dissidents in a seemingly “legal" way.
Rohrabacher believes that Zhong Dingbang was arrested for
attempting to break the monopoly of information by the CCP.
According to past experience, he is likely to face torture or worse,
Rohrabacher called for the international community’s continued attention in this case.
The same day, Amnesty International Taiwan Branch said
the British headquarters have been informed of the Zhong
case and will soon publish a global emergency bulletin.
Communist Party mouthpiece, Xinhua, alleged that Zhong was
arrested for guiding mainland residents to the TV spots,
and was suspected of behaving in a way likely to endanger security.
It is understood that from the 1999 persecution of Falun Gong,
“Falun Gong" television spot events occurred in many parts of China.
The most influential is the one on March 5, 2002 in Changchun.
Hundreds of thousands of people overnight understood
what Falun Gong was and learned of the persecution.
This time the regime has arrested Taiwan practitioner
Zhong Dingbang.
Many commentators believe that this is due to the CCP´s fear of
the spread of Falun Gong truth.
Beijing lawyer Tang Jitian pointed out that under mainland´s
special conditions,
not only religious groups, but also other groups,
are having difficulties learning the truth effectively.
China´s rules contradict people´s actual needs and civil rights;
the provisions for which are behind international and world trends.
Tang Jitian:" Either Xinhua News Agency, or handling units,
make such a statement or declaration to the outside world.
If only for the sake of belief, whether it is Public Security Bureau,
the Administration of Work Safety, Political Committee, or 610,
they have made investigations to prosecute or
for future trial implementation, none of them is legitimate."
Mainland human rights lawyer, Li Xiangyang said that
It is legitimate for Zhong Dingbang to help his friend or others to receive any television broadcast messages.

department of mainland China, for departmental interests or maintaining the CCP’s autocratic rule,
they can violate the Constitution or go against public opinion,
to enact rules, regulations and to force Chinese citizens to comply.
Li Xiangyang, “Zhong´s practice is humane,
the Chinese authorities should unconditionally release him.
Tang also pointed out that the reason to detain Zhong by
national security agencies was “endangering national security".
This law´s rationality and human rights standards are far apart.

this general crime has a problem itself in legislation in China.
Many normal citizens´ rights are within the contents of law
but because this hurts the privileged class, it was classified as endangering national security.
In fact, many are not endangering national security,
but only harmful to the interests of a small group
who are the privileged and are monopolizing everything."
Zhong´s family members petitioned the Presidential Palace
on June 27 and
requested security protection for a local lawyer at government
level to ensure that Zhong´s human rights are not infringed Zeng Yongfu,
Taiwan’s Minister of Justice and the Ministry of Justice of”
International and cross-strait Legal Division,"
called on the Chinese regime to deal with Zhong´s case
with transparency during the judicial process.
