【新唐人2012年3月8日訊】前「康達律師事務所」合夥人李莊律師，日前在博客中發表他的助手馬曉軍的文章，馬曉軍披露重慶當局製造李莊事件的背後黑幕，江北分局李副局長在2011年二月親口說，李莊案涉及到政治問題。文章詳述了警方軟禁和恐嚇馬曉軍，要求他不出席李莊案庭審和作證的細節。李莊接受本臺記者採訪時表示，新披露的內幕將對他的申訴有所幫助。
李莊在重慶打黑案中，替被指為「黑老大」的商人龔剛模辯護，後被龔剛模舉報「偽造證據、妨害作證」。2009年12月10號，重慶市公安局對李莊立案偵查。
龔剛模究竟有無受到刑訊逼供，是李莊案最核心的問題。馬曉軍文章中披露，當年他和李莊一起會見龔剛模，親耳聽到他描述自己遭到刑訊逼供的經歷。龔剛模說，他被吊起來八天八夜，腳尖可以踩到電腦桌上，但腳跟夠不著。吊的他大小便失禁，那些糞便順著褲腿往下流。
馬曉軍在文章中披露，他在2009年12月13號被重慶警方抓捕，當晚關押在北京朝陽區看守所，隔天被押送飛往重慶，下飛機後，警方像對待恐怖份子一樣，把他戴上黑頭套。
在江北看守所，他連續90多小時沒有睡覺，神智不清，加上警方的高壓威脅等，他被迫在警方事先編好的筆錄上簽了字。警方並逼迫他給全國律協寫一份致歉信，承認他沒有對李莊的所謂「違法違紀行為予以制止」。
李莊案一審開庭前的一天，警方再次提訊馬曉軍，在警方的反覆威逼下，馬曉軍在法官面前完成一份筆錄，內容寫道「沒有受脅迫，不願意出庭作證，該筆錄內容屬實」。
李莊在接受《新唐人》採訪時表示，馬曉軍披露的黑幕令人震驚。他最近將前往重慶為自己的冤案申訴。他認為馬曉軍披露的幕後真相對申訴有所幫助。
李莊：「這畢竟是一個申訴的新證據。因為按照法律規定，申訴應該有新的東西出來，有足以推翻原來認定的事實和依據。那麼這就是一個新證據。」
李莊表示，他很快還要在博客上發表新內容，把相關的很多的黑幕一點一點的揭開。
雖然打黑幹將王立軍在投奔美國領事館之後，被中央帶走下落不明，但是「唱紅打黑」的總指揮薄熙來仍然穩坐重慶市委書記。當初製造李莊冤案的權力之手依然籠罩著重慶。李莊的申訴會成功嗎？李莊表示，阻力之大是不言而喻的。但是他的決心不會改變。
李莊：「勝算與失敗，這不在我的考慮範圍之內。我就是把事實真相揭露出來，履行一個公民起碼的職責。履行一個法律人應該做的工作而已。至於勝算和失算，這不在我的考慮範圍之內。」
馬曉軍和妻子韓會娟2月7號起訴重慶警方，指控對方在調查李莊案過程中，涉嫌非法限制他們的人身自由。據報導，重慶江北區法院已收到相關訴訟材料和委託手續，但還沒有就是否立案表態。
大陸法律學者譚敏濤撰文指出，隨著李莊和馬曉軍相繼發力披露李莊案黑幕並起訴重慶警方，李莊案的辦案人員們面對此情此景肯定心急，因為他們的「刑期」不遠了。當王立軍出逃美國領事館的新聞傳到他們耳邊時，他們是否也在構思自己的「出逃計劃」？

Ma Xiaojun Reveals Li Zhuang’s Case Inside Story
Former Kangda Law Firm co-owner, lawyer Li Zhuang,
recently posted an article on his microblog, wrote by his
assistant Ma Xiaojun.
The article revealed that Chongqing authorities had
manipulated Li Zhuang’s case.
Jiangbei branch’s vice police chief Li said in Feb. 2011,
that Li’s case had involved political issues.
The article also disclosed that Ma Xiaojun had been
under house arrest and threatened.
Ma was asked not to attend Li’s trial and wouldn’t
give testimony.
Li Zhuang told NTD that the article disclosed new details,
which will support his appeal.
During Chongqing’s “anti-mafia" campaign, Li Zhuang was a
lawyer for Gong Gangmo, a key “mafia” businessman.
Later Gong reported that Li Zhuang had faked some evidence.
On 10th Dec., 2009, Chongqing police registered Li Zhuang’s
case for investigation.
Whether Gong Gangmo has been forced into confession is the
key issue against Li Zhuang’s case.
Ma Xiaojun revealed that he and Li met with Gong,
Gong told them he was tortured into confessing.
Mo said that he was hung up for 8 days and nights, his toes
could touch a table but his heels couldn’t. This resulted in incontinence.
Ma’s article exposed that on 31st Dec., 2009, he was
arrested by Chongqing police.
He was held in Chaoyang district police custody in Beijing,
then he was transferred to Chongqing by plane the next day.
When they arrived, police treated him as a terrorist,
covering his head with a black hood.
In Jiangbei detention centre, for about 90 hours Ma couldn’t
sleep, his mind was unconscious.
In addition to this, the police furiously threatened him, forcing
him to sign some paper which had been prepared by police.
Furthermore, police forced him to send an apology letter to
the Lawyer Association, admitting that he didn’t prevent Li Zhuang from “violating the law".
On the day before Li Zhuang’s first court hearing, police held
another arraignment to Ma Xiaojun’s case.
Under police’s repeated threatening, Ma had to sign the
paper in front of a judge.
It stated that “Without any force, I will not testify in the hearing,
the notes given above are true."
Li Zhuang told NTD that Ma’s disclosure is shocking.
Li will travel to Chongqing appealing on behalf of himself.
Li Zhuang believes, the truth that Ma has revealed will
help his appeal.
Li Zhuang: “This is new evidence. According to the law,
appealing should have new evidence.
This is enough to overthrow the previous ‘facts and evidence’.
Since this is new evidence."
Li Zhuang said that he would post new text on his microblog,
disclosing many inside stories one by one.
“Anti-mafia" hero Wang Lijun fled to the US consulate, was
taken away by Beijing officials, and disappeared from the public.
The boss of “Sing the Red Song and Anti-Mafia” campaign,
Bo Xilai, is still in the position of secretary of Chongqing Municipal Committee.
The manipulating power behind Li Zhuang’s case still exists
in Chongqing. Can Li Zhuang win the appeal?
Li said, it is hard to describe the great obstacles ahead, however,
he will not change his mind.
Li Zhuang: “Win or lose is not part of my consideration. I just
want to clarify the truth, to fulfil a citizen’s responsibility;
To fulfil an attorney’s mission.
Win or lose is not part of my consideration."
Ma Xiaojun and his wife Han Huijuan sued Chongqing police
on 7th Feb.
They suspect police illegally restricted others freedoms during
the procedure of investigation on Li’s case.
Sources said that Jiangbei district court in Chongqing has
received litigation documents and commission procedures.
However, the court hasn’t commented if a case will be filed for
investigation or not.
Scholar lawyer Tan Mintao pointed out, following Li Zhuang
and Ma Xiaojun’s action on disclosing the inside story
behind Li Zhuang’s case, and the lawsuit of Chongqing’s police,
those who were involved in the investigation of Li’s case will surely be worried now.
Because the day to send them to trial is not far.
After hearing about Wang Lijun’s defection incident, will they also plan the same move?
