【新唐人2011年8月4日讯】知名维权人士王荔蕻,因参与“福建三网友围观”活动遭到拘留。而中共当局对她的罪名也一再更改,从“寻衅滋事罪”到“聚众扰乱交通秩序罪”,再改回“寻衅滋事罪”。王荔蕻的罪名为什么让中共如此反复难定?中共又在打什么主意?请看报导。
维权人士王荔蕻的代理律师刘晓原在推特网上表示,8月1号北京朝阳区温榆河法庭在对王荔蕻的起诉书上,再次将罪名改回“寻舋滋事罪”。刘晓原认为,当局找不到王荔蕻“聚众扰乱交通秩序”的定罪证据,才又改为“寻舋滋事”,这个罪名打击面很大,更容易用来定罪。显示当局对王荔蕻判罪的决心,是要以维稳的晃子压制维权人士。
维权人士赵连海表示,对王荔蕻不论是“聚众扰乱交通秩序罪”,还是目前的“寻衅滋事罪”,都是莫须有的罪名,非常不公平。
赵连海:“官方在目前来讲,我想常变更罪名是因为他们所谓“聚众交通秩序罪”是完全不成立的,根本不成立的。目前他们就把很多无法确定的这些这个情况,都套到‘寻衅滋事罪’里。”
王荔蕻的儿子齐建翔说,有多名曾参与过"福建三网友围观团"的网友表示,愿意为他母亲王荔蕻作证,让当局难以用“聚众扰乱交通秩序”来定罪。当局这种先定罪名,后找证据的做法,说明他们已经达到丧心病狂的程度。
而王荔蕻的辩护律师韩一村向《美国之音》表示,“聚众扰乱交通秩序罪,从证据上说,是严重不足,证据不充分。而刑法规定的寻衅滋事罪规定的笼统、宽泛。它犹如一个口袋,是或不是,它都可以往里装。”
赵连海:“目前这个“寻衅滋事罪”,他基本上像一个大框一样,很多维权人士都是用这个罪名来对待,这个罪名是一个非常模糊一个罪名,本身它也是一个莫须有罪名,王大姊呢,怎么说呢,今天遭受这样的对待,我们非常多的人士非常痛心的。”
韩一村律师表示,案件已经进入庭审阶段后,法院应当向辩护律师提供案件所有相关资料,但是朝阳区法院拒绝为他复制警方向法院提供的视频资料。他对法庭是不是能公平公正审理王荔蕻不表乐观。
香港的“中国维权律师关注组”执行秘书潘嘉伟分析指出,中共当局过去都是指定罪名,然后再根据罪名判罪,这样多次更换罪名,说明当局正在为她罗列比较容易的罪名,这是当局滥用法律打击维权人士典型的案例。他呼吁更多的港人站出来支持王荔蕻。

Wang’s “Trouble-Making Crime”
Well-known human rights activist Wang Lihong participated
in Fujian Three Netizens’ activities and has been detained.
Chinese authorities repeatedly changed her charges, from
“trouble-making” to “gathering a crowd to disturb traffic order”.
Why is it so hard for the communist regime
to decide on her charges? What is behind it?
Rights activist Wang Lihong’s attorney Liu Xiaoyuan
said on Twitter, on August 1 that
the court in Beijing’s Chaoyang District,
again changed Wang’s charges to “crime of trouble-making”.
Liu Xiaoyuan said that the authorities could not find
evidence for “gathering a crowd to disturb traffic order”,
so they changed the charges back to “trouble-making”.
This charge is more general and makes the conviction easier.
It shows authorities are determined to convict Wang Lihong.
They want to suppress human rights activists
using the excuse of maintaining stability.
Human rights activist Zhao Lianhai said, whatever Wang’s
charges, they are all trumped up and it is simply unfair.
Zhao Lianhai: I think the reason that
authorities often change charges is that
“gathering a crowd to disturb traffic order”
just does not have any base.
Now when they can’t decide the charges,
they simply label it “crime of trouble-making.”
Qi Jianxiang, Wang’s son said many people took part in
Fujian Three Netizens event are willing to testify for Wang,
so the authorities cannot convict her with
“gathering a crowd to disturb traffic order.”
Having the charges prior to finding the evidence
shows that the authorities are already desperate.
Wang Lihong’s attorney Han Yichun told Voice of America:
“For the ‘crime of gathering a crowd to disturb traffic order’,
the evidences are seriously inadequate and insufficient,
while provisions on trouble-making crime are quite general.
It is like a pocket; anything can be put into it.
Zhao Lianhai: “Nowadays, ‘trouble-making crime’
is being widely used against human rights activists.
But this crime has a very vague definition.
It is itself a non-existing crime.
Wang Lihong, is currently charged with that,
and we all are very saddened by it.”
Attorney Han Yichuna said, the case has entered trial stage.
The court should provide all relevant information to the
defense counsel.
However, the Court of Chaoyang District refused
to give him a copy of the video provided by the police.
He is not positive
the court will give Wang Lihong a fair trial.
Patrick Poon, Executive Secretary of Hong Kong’s
“China Human Rights Lawyers Concern Group" pointed out
that the Chinese authorities in the past gave certain charges,
then they would convict the defendant under these charges.
Now they change charges again and again, which shows
they first create a list of charges and
then choose the easiest to convict the person with.
This is a typical case of authorities abusing laws
against human rights activists.
He called for more people to come forward
and support Wang Lihong.
