【新唐人2011年7月5日讯】在中国,公民拥有集会结社的自由,虽然写入了宪法,但其实每每被中共视为违法,轻则驱赶打压,重者关押判刑。对此,有民众提出质疑,中共大搞七一集会,是否也提出了申请以及得到同意?是否合法?
中共的90周年所谓的大庆活动,最引人瞩目的就是7月1号在人民大会堂召开的会议。同时,全国各地基层党委也都在举行相应的庆祝活动。
《法国国际广播电台》3号刊登了一篇网友的来信,对中共“7.1”集会是否具有合法性提出质疑,同时他还提出了以下三个问题:
第一,7月1号中共举行的建党集会,是否遵照中国有关“集会、游行、示威”等的法律,办理了相关手续?是不是也向北京市公安局递交了“集会申请”等?公安机关的批复又如何呢?
第二,中共从根本上来说,也是一个社团组织,不知是否遵照有关“结社”等的法律,办理了相关手续?什么时候申请注册的?年检情况又是如何?
第三、中共建党集会,不知它的具体花费是怎样的,是不是花13亿纳税人的钱?
大陆作家荆楚认为,这位网友提了一个根本性问题。
荆楚:“第一,你们组织这些游行,这些建党的大型集会活动,按照你自己颁布的法律,你申请了没有?那如果没有申请的话,那就是违法了。第二,就是这个社团组织,你中共颁布的社团登记法,你共产党一直没有登记,没有年审,那你中共就是一个非法组织。”
美国乔治梅森大学教授章天亮博士表示,他相信中共并没有办理相关的手续。
章天亮:“中国它是一党专制的国家,所以它整个的权力都掌握在共产党的手里,如果你要共产党去民政部登记,或者说共产党游行示威的话,还需要公安局批准的,那对共产党来说,是不可思议的事情。”
《法广》还介绍了一位署名“匹夫”的听友在今年一月发来的文章。标题是《我们解放了吗?》。
文章说,中共一直号称“解放了全中国”,可是中国人民真的解放了吗?
章天亮认为,共产党在执政过程中,开发出自己的一套“党文化”,里面有它自己的一套话语系统。
章天亮:“所谓的“解放”,它实际指的是,共产党自己高官厚禄,醇酒美人过着这样的日子,实际上‘它解放出它 自己’,对老百姓来说是一种‘奴役’,但是,在共产党的字典里,这就是‘解放’。”
章天亮指出,在中共的话语系统里,用词可能与普通人用词一样,但表达出的含义与字典里的完全不一样。
荆楚认为,在“国民政府时代”,自由是“多和少”的问题。在“共产党的统治下”,自由是“有和无”的问题。他认为,在中国的社会里根本没有自由,没有解放,只能叫奴役。
“匹夫”在文章也表示,真正获利最大的解放者,是党,是党的权力,党的领导者。

Are CCP’s July 1 Rallies Legal?
The Chinese constitution stipulates that
citizens have freedom of assembly and association.
In reality, the authorities see such activities as illegal.
Participants have been oppressed or jailed frequently.
Thus, some people question the legality of
the Party’s own July 1 rallies.
The Chinese Communist Party (CCP) celebrated its
90th anniversary on July 1 with meetings and rallies.
Meanwhile, across China, all levels of
party committees also engaged in celebrations.
On July 3, Radio France Internationale (RFI)
published a Chinese netizen’s letter
questioning the legitimacy of CCP’s rallies:
First, did the CCP’s July 1 meetings comply with
the procedures of assembly, parade or demonstration?
Did the CCP submit its request to the police?
Was the request approved?
Second, the CCP is also a community organization.
Did it comply with the relevant rules and procedures?
Did it apply for registration?
What are the results of its annual inspection?
Third, how much did the CCP spend on its rallies?
Did it use the 1.3 billion taxpayers’ money?
Mainland-based writer Jing Chu believes that
this netizen raised a fundamental question.
Jing Chu: First, you (i.e. the CCP) organized parades,
but did you follow the procedures set by yourself?
Did you apply for permission? If not, they are illegal.
Second, as a community organization,
the CCP is not registered and has no annual inspection.
Therefore, the CCP is an illegal organization.
George Mason University Prof. Zhang Tianliang
believes that the CCP has not complied with
the relevant procedures.
Zhang: China is a one-party authoritarian state,
so its powers are vested in the hands of the CCP.
It is inconceivable that the CCP needs to register
with the Civil Affairs Bureau, and get an approval
from the police bureau, to hold demonstrations.
RFI published another audience member’s article
titled “Are we liberated?"
The article says that the CCP always claims to
have liberated China, but are the Chinese truly freed?
Zhang believes that the Communist Party developed
its own set of “Party culture", which contains
its own special system of language.
Zhang: The so-called “liberation" actually means
the CCP officials getting to live a life of riches,
privileges and debauchery.
It “liberates itself", while it enslaving the people.
In the dictionary of the CCP, that is called “liberation".
Zhang points out that in the CCP’s language system,
there are the same words as in our daily vocabulary.
However, they would have totally different meanings.
Jing believes that when Kuomintang governed China,
there was some freedom for the people.
Under the CCP, there is hardly any freedom.
He thinks that in the Chinese society,
there is no freedom, no liberation and only slavery.
Pifu’s said in his article, the winners of the liberation
are the CCP, the CCP’s power and its leaders.
