【新唐人2013年07月04日訊】前《紐約時報》簽約攝影師、記錄片製片人杜斌，「六四」前夕被北京警方以「涉嫌尋釁滋事罪」秘密拘捕，中共的作法一度引起國際上的譴責。日前，杜斌的委託律師向北京豐臺拘留所提交取保候審申請書，卻遭警方駁回。
杜斌的委託律師浦志強日前對《美國之音》表示，杜斌被捕前，幾乎沒有出過家門，警方所謂杜斌涉嫌犯有「尋釁滋事罪」非常荒謬。同時，浦志強說，杜斌的行為符合取保候審條件。
南京「東南大學」法學教授張讚寧表示，即便「尋釁滋事罪」構成的話，也可以「取保候審」。
南京東南大學法學教授張讚寧：「可能判3年以下有期徒刑的人，那麼就可以取保候審。那麼它（當局）不給予辦理取保候審也是不符合法律規定的。」
浦志強說，他在北京豐臺拘留所會見了杜斌，也為杜斌提交了取保候審申請書，但是卻遭到北京警方的駁回。
據了解，構成「尋釁滋事罪」包括：1、隨意毆打他人，情節惡劣的；2、追逐、攔截、辱罵他人，情節惡劣的；3、強拿硬要或者任意損毀、佔用公私財物，情節嚴重的；4、在公共場所起鬨鬧事，造成公共場所秩序嚴重混亂的。
因此，張讚寧指出，杜斌發表的作品都是真實的事件，不應構成任何犯罪。
杜斌今年4月製作的《小鬼頭上的女人》記錄片中，親身經歷者講述了在遼寧「馬三家女子勞教所」裡，遭受各種非人道「酷刑」。而在5月底，杜斌又出版了《天安門屠殺》一書，但隨後失蹤，後來得知杜斌在出書的同一天，已經被警方秘密拘捕，並且以涉嫌「尋釁滋事罪」拘留在北京豐臺拘留所。
張讚寧認為，當局的做法，違反中國的憲法。
張讚寧：「他這個出書，是符合中華人民共和國憲法的規定。憲法規定人們有出版自由，所以，他是不構成任何犯罪的。」
時事評論員唐靖遠表示，中共對所有敢於說真話的異見者，從來都是不擇手段的打壓。
時事評論員唐靖遠：「只要所謂形勢需要或者是政治需要，它們就可以隨意的編造或者是強行扣上一個罪名來進行打壓，至於這個罪名在法律上究竟是不是成立？它們其實並不在意，因為現在的中共它們根本就不講法律。就是所謂黨的意志可以領導一切，它們自己制定的法律也不過只是它們施行獨裁統治的工具，隨意而用而已。」
唐靖遠指出，「馬三家勞教所」由於迫害法輪功學員而臭名昭著，在海外主流媒體的廣泛報導下，「馬三家」已經成為迫害法輪功的一個像徵性的場所和標誌，而杜斌導演的記錄片《小鬼頭上的女人》正好踩到了中共的痛處。
唐靖遠：「中共對法輪功的這種殘酷迫害，一直都是它最害怕曝光的一個死結，杜斌的這種行為可以說是直接觸及到了中共最敏感的禁區。」
唐靖遠認為，中共對杜斌實施這種生拉硬拽，並且給扣上一個不相干的罪名，把人關押起來的行為，反證了「馬三家」及其它勞教所恐怖內幕的真實性。
一些曾經經歷「馬三家勞教所」酷刑折磨而上訪的人士，也在豐臺看守所外舉牌抗議，要求中共當局立即釋放杜斌。
杜斌的辯護律師浦志強表示，北京警方只能拘留杜斌37天，如果屆時不放杜斌出來，就要進行正式起訴。

Chinese Government Rejects Du Bin’s Bail Application
Former New York Times contract photographer,
documentary filmmaker Du Bin,
was secretly arrested by Beijing police for the
alleged crime of provocation on the eve of June 4th.
The CCP’s practice triggered international condemnation.
Recently, Du Bin’s lawyer submitted a bail application
to Beijing Fengtai Detention Center, but it was rejected.
Du Bin’s lawyer, Pu Zhiqiang, recently told Voice of America
that Du Bin hardly left his home before his arrest.
The alleged “crime of provocation"is simply absurd.
Meanwhile, Pu Zhiqiang said Du Bin meets
all bail requirements.
Law professor Zhang Zanning at China’s Southeast
University said that even criminals of “provocation" have the right to be bailed out.
Zhang Zanning: “Those sentenced to three years of
imprisonment with little possibility of harming society can be released on bail.
Then it is illegal that the authorities do not grant bail
to Du Bin."
Pu Zhiqiang said he met Du Bin in Beijing Fengtai Detention
Center and also submitted a bail application, but it was rejected by Beijing police.
Crime of provocation means seriously assaulting others,
chasing and abusing others, forcibly taking or damaging
public or private property creating disturbances
in public places, or causing serious disorder.
Zhang Zanning pointed out that Du Bin published works
based on real events, which does not constitute a crime.
Du Bin released his documentary “Above the Ghosts’ Heads:
The Women of Masanjia Labour Camp"this past April.
In the documentary he tells the story of those who
experienced various inhumane tortures in Liaoning’s Masanjia Women’s Camp.
At end of May, Du Bin published a new book
“Tiananmen Massacre."
Then he disappeared, and it was later learned that Du Bin was
arrested by secret police the same day his book was published.
He is now detained in Beijing Fengtai Detention Center
on charges of “crime provocation."
Zhang Zanning considers such a practice as undermining
China’s image of rule of law.
Zhang Zaning: “Du Bin’s publication of his book
is in line with PRC’s Constitution,
which provides people the freedom of speech and
publication. So he did not commit any crime."
Commentators Tang Jingyuan said that the CCP always
unscrupulously suppresses all dissidents who dare tell the truth.
Commentator Tang Jingyuan:"As long as the situation
or the so-called ‘political needs’require, the CCP can freely invent a crime to suppress people.
They do not care whether such a crime holds valid against
the law or not, because the CCP does not abide by the law at all.
The Party’s will resides above all laws, which serve
as nothing but their tool of dictatorship."
Tang Jingyuan pointed out that Masanjia Labor Camp
is notorious for the persecution of Falun Gong practitioners.
Reported by overseas mainstream media, Masanjia has
become a symbol for the CCP’s persecution of Falun Gong.
Du Bin’s documentary exposed the CCP’s key problems.
Tang Jingyuan: “The persecution of Falun Gong has
always been the CCP’s most sensitive topic, whose exposure it is more fearful of.
Du Bin bold act directly poked the CCP’s most sensitive area."
Tang Jingyuan believes that the CCP’s detention of Du Bin
on a forged charge serves as an evidence of the truthfulness
of the persecution in Masanjia and CCP’s other labor camps.
Some of those petitioners who experienced torture
in Masanjia hold placards to protest outside Fengtai Detention Center.
They require the Chinese authorities to
immediately release Du Bin.
Du Bin’s lawyer, Pu Zhiqiang, said Beijing police
can only detain Du Bin for 37 days.
If Du Bin is still not released by then,
he will formally sue the police.
