【新唐人2012年9月26日訊】美國移民局近來加快處理公民歸化的申請，有不少華人遞交歸化申請N-400表格時，被美國移民局官員問及「是否是共產黨員」，不只大陸人士，甚至台灣、香港等地申請美國移民的華人，也被盤問是否擁護共產黨政權。美國律師表示，美國移民法規定，共產黨員及其所屬組織者，不得移民美國，如發現違反規定說謊者，可以遞解出境。
根據美國早期的移民法規定，凡是隸屬於共產黨及其所屬組織者，不得移民美國。在入境之後，如果被發現隸屬共產黨，將被遞解出境。
美國華府人權律師葉寧：「法律的根據是美國移民法第212條規定，共產黨和極權主義組織的成員，或者是共產黨的下屬組織或者外圍團體的成員，第一，不准入境﹔第二，不能造成身份﹔第三，可以遞解出境。」
幾位來自大陸，現今已經移民美國的人士接受了《新唐人》的採訪，下面請聽聽他們的看法。
旅美大陸人士范岵昶：「大家都知道共產黨這個東西很不好呀，很壞呀，你如果以前加入過這個組織的人，你在這個組織工作的人，肯定受到不好的薰陶，很多不好的感染。」
移居紐約之上海人士蔡桂華：「作為維護美國的價值觀念，保護這一塊淨土，不被共產主義邪靈所侵蝕，那麼作為移民局，他暫且執行了美國的價值觀念，嚴格把關，我覺得是應該值得推崇的。」
移居紐約之武漢人士張正：「美國的立法之本，就是捍衛人權，基本人權，跟共產黨走的這些人，如果過來的話，他會搗亂，也會對美國造成一些混亂，所以美國已經看清了這個問題，是個好事情，會幫助中國人民能夠儘早的擺脫中共的邪惡統治。」
不過，美國素有「貪官天堂」之稱，據了解，中國外逃官員入境美國或取得永久居留權時，往往刻意隱瞞中共黨員和官員的身份。
美國華府人權律師葉寧認為，美國並非中共貪官的首選之地，因為美國是世界聯合國「反腐敗公約」的締約國，此外，美國又是一個重視法制的國家，美國聯邦調查局對外國轉進來的財產非常警覺。
葉寧：「你不能到了美國想爭取移民利益，又隱瞞共產黨的身份，而且，繼續死心塌地的為共產黨政權賣命，那你就變成一個現行的極權主義份子，那就是罪上加罪。」
移民紐約的時事評論員洪劍表示，自從王立軍事件發生以後，中共活摘器官的資料陸續被曝光並且證實，美國政府很有可能已經了解這個事情，並且受到很多國家以及良知人士的譴責。
時事評論員洪劍：「從移民官的角度來說，他問這個問題是非常的必要的，因為邪黨活體摘除法輪功學員的器官，這個行為已經是不是人的行為了，那凡是加入中共的，美國不會接受這樣的人。」
葉寧表示，中國共產黨員如果曾經參與或支持中國民主運動，甚至抵制中共政權鎮壓異議人士和法輪功學員等，美國政府都會嚴格保護這類受到政治迫害的人士。

United States Rejects Immigration of CCP Members
The U.S. Citizenship and Immigration Services (USCIS)
recently sped up its processing of naturalized citizenship.
The immigration application form N-400 asked Chinese if
they were members of the Chinese Communist Party (CCP).
Those from Taiwan and Hong Kong were also asked
whether they supported the CCP regime.
U.S. lawyers say the U.S. immigration law refuses
immigration to communists and CCP subordinates;
those found violating the law would be deported.
According to early American immigration law,
members of the CCP and its affiliated organizations
cannot immigrate to the United States;
anyone found to be linked to the CCP
would be deported.

“The legal basis is the provisions of Article 212 in the U.S. immigration law.
Members of the Communist party and totalitarian
organizations, or the affiliated organizations,
shall not enter U.S. territory; shall not obtain an identity;
and can be deported."
Several U.S. citizens originally from China were interviewed
by New Tang Dynasty (NTD) TV—let’s take a look.
[Fan Huichang, U.S. Immigrant from China]:
“We all know that Communism is very, very bad!
If you joined the party before, or if you work for it, you have
certainly been raised badly and have become affected.”
[Cai Guihua, New Yorker from Shanghai]:
“To safeguard the values of the United States, to protect this pure land from erosion of evil spirits of communism,
as immigration authorities, they perform the values of
the United States, strictly censored everyone—I think that should be worthy of praise."
[Zhang Zheng, New Yorker from Wuhan]:
“U.S. legislation is to defend human rights—basic human rights.
If those people working with the Communist Party came,
they would cause troubles and chaos to the U.S.,
and the U.S. government is clear on it; it’s a good thing,
and could help Chinese to get rid of the CCP earlier.”
However, the United States is known as being a paradise for
corrupt communist officials.
Officials fleeing China deliberately conceal their identities
as CCP members when applying for permanent residency.
Ye Ning believes the U.S. is not the first choice
for China’s corrupt officials,
because the U.S. is a signing member of
the United Nations Convention against Corruption,
and because it emphasizes the legal system.
The U.S. Federal Bureau of Investigation (FBI)
stays alerted on foreign assets entering the country.

“You cannot conceal your CCP member identity in order to immigrate to the U.S.,
and meanwhile continue to work for the CCP regime.
Otherwise, you become a current totalitarian element,
which is more than a sin."
[Hung Kim, Political commentator, New York Immigrant]:
“After the Wang Lijun event, evidence of organ harvesting carried out by the CCP were disclosed and confirmed.
The US government may have already known the truth
(about the organ harvesting crimes)and
were also condemned by people with a conscience
in many countries.”
[Hung Kim, Political commentator]:
“From the point of view of an immigration officer, it is very necessary for him/her to ask the question,
because the evil CCP harvested organs from
living Falun Gong practitioners;
this behavior is inhuman, and the United States
won’t accept members of CCP.”
Ye Ning says if CCP members had supported and participated
in democratic movements in China and
resisted the CCP’s persecution of dissidents and
Falun Gong practitioners,
then the US government would strictly protect them.
