【新唐人2011年11月16日訊】中國人權活動家、藝術家艾未未被北京當局指控逃稅，需在近幾天的期限內繳納1522萬欠稅款。在過去一個多星期裡，艾未未總共接到將近3萬筆來自民間的自動借款，總金額將近870萬元。艾未未的公司14號提交了845萬元的存款單，作為欠稅罰款的行政復議擔保金，但是遭北京稅務機關拒絕。艾未未自稱他的生活已經變成了一部《好萊塢片》。
11月14號，艾未未的「發課公司」法人代表路青，前往北京地稅局第二稽查局遞交存款單，辦理納稅擔保被拒收。北京稅務機關臨時通知發課公司，他們不再按原計劃收存款單，這800多萬元必須直接打到稅務部門指定的一個帳戶上。
不過，艾未未的律師浦志強表示，存款單做為納稅擔保的質押方式是符合法律規定的。根據中國的法律，納稅人如對稅務機關的處理決定不服，有權利申請行政復議，但必須提供擔保。發課公司提供存款單作為行政復議擔保，如果敗訴，再繳納全額稅款。
艾未未律師浦志強：「這不是稅務機關同意不同意的問題，這是法律規定的，納稅人可以選擇完稅或者是提供納稅擔保，而擔保分不動產抵押和不動產之外的動產質押，權利質押這種形式，存款單是法律認可的一種質押物，那我覺得發課公司選擇用這樣的方式就沒有甚麼好說的。」
在不到十天的時間裏，艾未未收到了近3萬名支持者借出的869萬多元人民幣。有一些不知名的支持者，把他們的捐款隔著院牆扔進院子裡。
艾未未在微薄上宣佈，借款活動截止。
英國《衛報》報導，艾未未表示，他的生活已經變成了一部《好萊塢片》。中國官員推出新的各種障礙，讓他難以為公司抗辯逃稅罪名。艾未未說：「他們搗毀了我的房子。他們對我進行毆打。他們把我秘密關押。現在再來這麼一張稅單。事情一件接一件。」
發課公司稅務代理稅務師杜延林表示，14號上午，已經把艾未未的上訴保證金錢轉帳到稅務局指定的臨時保管金帳戶中，以這種方式取得行政復議的權利。
發課公司稅務代理稅務師杜延林：「我們就只能只有最後一條路，把保證金打到稅務局銀行開立的稅收資金代保管帳戶，以這種方式提供擔保，來進行納稅擔保。然後才能履行下一步的法律程序。」
大陸著名媒體人莫之許15號在推特上寫道：「845萬憑證在此」，並轉發一張艾未未手拿兩張單據的照片。

Ai Weiwei tax evasion case starts new storm
Chinese Human Rights Activist and Artist Ai Weiwei was
accused by the Chinese regime of tax evasion and must pay 15.22 million yuan.
In the past week, Ai Weiwei has received 30,000 private
donations worth a total of ~8.7 million yuan.
Ai Weiwei’s company also submitted it’s bank deposit
slip of 8.45 million yuan as a security deposit,
but was rejected by the Beijing Tax authorities.
Ai Weiwei says his life has turned into a Hollywood movie.
On Nov 14, the legal representative of Ai Weiwei’s company
Lu Qing, went to deposit money at the Beijing Taxation Bureau,
but the security deposit was rejected. Beijing Taxation Bureau
told him, he can not pay the taxes through the normal method,
but instead the 8+ million must be directly deposited into an
account given by the Taxation Bureau.
However, Ai Weiwei’s lawyer Pu Zhiqiang expressed, using
a bank deposit slip as security deposit, is consistent with the law.
If the taxpayer does not agree with decisions made by the
tax authorities, then he has the right to appeal the decision,
but must first provide a security deposit.
If he loses his appeal, then he has to pay the full amount.
Ai Weiwei’s lawyer Pu Zhiqiang said, “This is not an issue of
the taxation Bureau, but the law.
The taxpayer can choose to pay the tax or provide a
security deposit,
and security deposits can be in the form of immovable
property or a pledge of movable property.
The use of a bank deposit slip as the security deposit
is allowed by law, so I don’t think there is anything to argue, as to whether this is allowed or not.”
In less than ten days, Ai Weiwei has received more than
30,000 private donations worth a total of 8.69 million yuan.
Some anonymous supporters simply threw the money
over the wall into Ai’s house.
Ai Weiwei has announced an end to his fundraising activity.
According to the Guardian, Ai Weiwei expressed that his life
has turned into a Hollywood movie.
Due to various obstacles introduced by the Chinese regime,
it’s very hard for Ai to fight the tax evasion charge.
Ai Weiwwei said, “They demolished my house, beat me up,
secretly prisoned me. Now there is this tax bill. One after another.”
Ai Weiwei’s tax accountant Du Yanlin expressed on Nov 14,
they have already transferred the money into the bank
account given by the Taxation Bureau, using this method to
seek an administrative review.
Du Yanlin stated, “We had to… this is the only way…
to transfer the money into the Tax Bureau Account,
using this method as a guarantee to see right of
an administrative review.. ”
On Nov 15th, renowned mainland media personnel
Muo Zhixu wrote on his micro-blog,
“Proof of 8.45 million security deposit,”
with a picture of Ai Weiwei holding two receipts.
